2. The applicant requests correction of his military records to show entitlement to an selective reenlistment bonus (SRB) of 2B.
3. The applicant contends that although he became eligible for reenlistment in October 1995, it was not until January 1996 that he was so advised. When he did reenlist the SRB for military occupational specialty (MOS) 98G with Korean, Voice Interceptor, had been reduced to 1B.

4. On 5 February 1996 the applicant, with 6 years, 5 months and 20 days of total active service, reenlisted for 6 years. His reenlistment contract indicates that he reenlisted in MOS 98G with Korean for an SRB-1B with 50 percent payment option.

5. In the processing of this case, a staff advisory opinion was obtained from the Total Army Personnel Command (PERSCOM). PERSCOM advised that MOS 98G with Korean was decreased from 2B to 1B, effective 4 January 1996. If the applicant had been timely notified he could have reenlisted prior to the bonus decrease. PERSCOM recommended granting his request.

CONCLUSIONS :

1. The applicant was properly reenlisted in pay grade E-5 in MOS 98G with an SRB-1B. However, it appears that he was not properly advised of his eligibility to reenlist at an earlier date when the bonus was at a higher rate.

2. Had the applicant been timely notified when he became eligible for reenlistment, it is reasonable to believe that he would have enlisted prior to the bonus decrease in his MOS.

3. Through no fault of his own, the applicant has been denied a financial gain for which he was otherwise qualified.

4. In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below.




RECOMMENDATION :

That all of the Department of the Army records related to this case be corrected by amending the 5 February 1996 reenlistment contract of the individual concerned to show entitlement to an SRB-2B for MOS 98G with Korean, as an exception to policy.
