2. The applicant requests correction of his military records to show entitlement to an selective reenlistment bonus (SRB) of 2B.

3. The applicant contends that although he became eligible for reenlistment in October 1995, it was not until January 1996 that he was so advised. When he did reenlist the SRB for military occupational specialty (MOS) 98G with Korean, Voice Interceptor, had been reduced to 1B.

4. On 5 February 1996 the applicant, with 6 years, 5 months and 20 days of total active service, reenlisted for 6 years. His reenlistment contract indicates that he reenlisted in MOS 98G with Korean for an SRB-1B with 50 percent payment option.

5. In the processing of this case, a staff advisory opinion was obtained from the Total Army Personnel Command (PERSCOM). PERSCOM advised that MOS 98G with Korean was decreased from 2B to 1B, effective 4 January 1996. If the applicant had been timely notified he could have reenlisted prior to the bonus decrease. PERSCOM recommended granting his request.

CONCLUSIONS :

1. The applicant was properly reenlisted in pay grade E-5 in MOS 98G with an SRB-1B. However, it appears that he was not properly advised of his eligibility to reenlist at an earlier date when the bonus was at a higher rate.

2. Had the applicant been timely notified when he became eligible for reenlistment, it is reasonable to believe that he would have enlisted prior to the bonus decrease in his MOS.

3. Through no fault of his own, the applicant has been denied a financial gain for which he was otherwise qualified.

4. In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below.

RECOMMENDATION :

That all of the Department of the Army records related to this case be corrected by amending the 5 February 1996 reenlistment contract of the individual concerned to show entitlement to an SRB-2B for MOS 98G with Korean, as an exception to policy.

The applicant requests correction of his military records by amending his 12 December 1995 reenlistment contract to show that he reenlisted on 9 January 1996 for a period of 6 years instead of 4 years. It opined, in effect, that a SRB-1B had been authorized for the applicant’s MOS on 1 January 1996 and had the applicant applied for a waiver to reenlist under his 90-day window, an exception would have been granted. It goes on to state that personnel are not authorized to reenlist outside of...

He goes on to state that had he known he required an additional 9 months to attend the school, he would have reenlisted for 4 years instead of 3 years in order to maximize his bonus entitlements. The applicant’s military records show that after serving 3 years, 7 months, and 26 days of total active service, he reenlisted on 3 January 1996 for a period of 3 years under the Army service school reenlistment option (Arabic language school) in military occupational specialty 98G, with...

The applicant requests correction of his military records by amending his 28 November 1995 reenlistment contract to show that he reenlisted on 4 December 1995 with entitlement to a selective reenlistment bonus (SRB)-2B. The supporting statements from the applicant’s chain of command (lieutenant colonel to lieutenant general) all attest that the applicant was scheduled to reenlist on 22 December 1995 and that because he was hand-picked for deployment to Hungary, he was advised to reenlist...

However, because the applicant reenlisted for 2 years instead of 3 years, he did not meet the minimum requirement of reenlisting for a minimum of 3 years to qualify for payment of the SRB. Had the applicant been informed that he would not have been eligible to qualify for an SRB by reenlisting for only 2 years, he could have requested an exception to the RCP to be reenlisted for a period of 3 years so as to qualify for payment of the SRB. The applicant states that his retention NCO miscalculated his service and thus misinformed him of the number of years he would be required to reenlist for in order to receive the SRB for his MOS. Although his reenlistment contract indicates that he was entitled to receive an SRB, he was subsequently informed that he would have had to reenlist for 4 years in order to qualify for the SRB. The Total Army Personnel Command (PERSCOM), in a comment to this Board, advised in effect, that the...
