APPLICANT REQUESTS:  That his date of rank for promotion to pay grade E-6 be changed from 1 July 1997 to 1 June 1997.

APPLICANT STATES:  That he made the cutoff scores for promotion to pay grade E-6 for 1 June 1997, however, his name did not appear on the promotion selection list.  Since he also met the promotion cut off score of 1 July 1997, he was promoted on that date.  

EVIDENCE OF RECORD:  The applicant's military records show:

The applicant enlisted in the Regular Army on 17 April 1990 and has remained on active duty thru continuous reenlist- ments.

In an advisory opinion to the Board (COPY ATTACHED), the Total Army Personnel Command (PERSCOM) advised, in effect, that Army Regulation 600-8-19 provides that soldiers are eligible for promotion to pay grade E-6 against monthly promotion scores.  Those scores become effective the first day of the third month following the selection month.  The applicant’s promotion points of 688 was inputted into the system in April 1997.  Therefore, the applicant became eligible for promotion 3 months later, when he met the promotion cut off score for 1 July 1997.  PERSCOM recommended denial of the applicant’s request.

DISCUSSION:  Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion, it is concluded:

1.  For the applicant to have been promoted to pay grade E-6 effective 1 June 1997, his promotion point score of 688 had to be in the system by March 1997.  He has not provided any documentation that this was the case. 

2.  Based on the evidence of record, the applicant’s promotion point score of 688 was inputted into the system in April 1997, making him eligible for promotion to pay grade E-6 on 1 July 1997.

3.  In view of the foregoing, there is no basis for granting the applicant’s request. 

DETERMINATION:  The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
