2. The applicant requests, in effect, retroactive promotion to pay grade E-5 effective 1 April 1997 and adjustment of his selective reenlistment bonus (SRB).

3. The applicant maintains that his submission of his DD Form 3355 was mishandled. In January 1997 he appeared before a promotion board and signed his Promotion Point Worksheet (DA Form 3355). Although he had completed Ranger training it was not listed on the worksheet under military education. He was assured that since he was ranger qualified that it did not need to be listed. After completing the Primary Leadership Development Course (a prerequisite for promotion to pay grade E-5) he received orders promoting him to pay grade E-5, effective 1 April 1997. On 7 May 1997 he reenlisted in pay grade E-5 in order to received an SRB 2A bonus. However, due to administrative error on the part of the personnel service battalion (PSB) the proper paperwork supporting his promotion points was submitted, and his promotion was invalidated. It was not until July 1997 that the proper paperwork was submitted thereby, making his promotion to pay grade E-5 effective 1 October 1997. In support of his application he submits letters from his chain of command confirming and supporting the request.

4. The applicant enlisted on 7 January 1992 and has remained on active duty through continuous reenlistments.

5. He completed the Ranger course and was awarded the Ranger Tab on 9 August 1996.

6. His DA Form 3355, dated 1 January 1997 awarded the applicant 465 promotion points.

7. Orders, dated 19 March 1997 promoted the applicant to pay grade E-5 effective 1 April 1997. Based on this promotion, the applicant reenlisted on 7 May 1997 for 5 years. His reenlistment contract shows that he held MOS 11B and was authorized an SRB 2A. Apparently, during a subsequent review, it was determined that the applicant’s DA Form 3355 was not accompanied with the proper paperwork to support the promotion points awarded for ranger training and the Ranger Tab and he in fact did not meet the promotion point cut-off scores for promotion to pay grade E-5 effective 1 April 1997. His promotion was apparently revoked (there are no revocation orders in the record reviewed). In July 1997 a promotion point adjustment was performed, and the applicant was subsequently promoted to pay grade E-5 effective 1 October 1997.

8. The Total Army Personnel Command (PERSCOM) in a comment to the Board advised, in effect, that its review of the case confirms the applicant’s contentions and recommended granting his request.

CONCLUSIONS :

1. The evidence of record supports the applicant’s contention that he was not properly supported by the PSB personnel in the processing of his DA Form 3355.

2. Due to the administrative errors, he was not awarded all of the promotion points that he had earned and was thereby denied a timely promotion. Had the PSB properly processed the promotion paperwork in January 1997 the applicant would have met the promotion point cut-off score for promotion to pay grade E-5 for 1 April 1997 vice having to wait until 1 October 1997.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION
:

That all of the Department of the Army records related to this case be corrected:

a. by showing that the individual concerned was promoted to pay grade E-5 effective 1 April 1997 with a same date of rank; and

b. by validating his reenlistment contract of 7 May 1997, in pay grade E-5, for 5 years in MOS 11B with an SRB of 2A.
