APPLICANT REQUESTS: That his date of rank for promotion to pay grade E-6 be changed from 1 April to 1 March 1997.
APPLICANT STATES: That had the Personnel Services Battalion (PSB) properly credited his DD 3355 (Promotion Point Worksheet), with 10 points for educational improvement, he would have met the promotion cut off score for 1 March 1997.
EVIDENCE OF RECORD: The applicant's military records show:
The applicant enlisted in the Regular Army on 18 May 1988 and has remained on active duty thru continuous reenlist- ments.
An initial DA Form 3355, dated 6 November 1996 awarded the applicant 728 promotion points. The applicant signed the document indicating that the administrative points were accurate and correct.
He was promoted to pay grade E-6 effective 1 April 1997, with the same date of rank.
In an advisory opinion to the Board (COPY ATTACHED), the Total Army Personal Command (PERSCOM) advised that Army policy provides that the addition of points not previously documented will be made during the month the request is received at the PSB and inputted into the system. The scores become effective the first day of the third month following the selection month. The applicant processed his promotion point adjustment on 20 February 1997 and his adjusted score became effective on 1 May 1997. PERSCOM recommended denial of the applicants request.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion, it is concluded:
1. There is no evidence that the applicant attempted to receive credit for his educational improvement on his initial DA Form 3355. Rather, by his signature, he certified the listed administrative points were correct.
2. In view of the foregoing, there is no basis for granting the applicants request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
