AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE		 CASE NUMBER

GENERAL: The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING:         The Board grants upgrade of the discharge, change of narrative reason and change of the reenlistment code.

ISSUE: The applicant received a General discharge for Misconduct -Minor Disciplinary Infractions

The Air Force Discharge Review Board , under its responsibility to examine the propriety and equity of an applicant's discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted . In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption , to include evidence submitted by the applicant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. In order to adhere to Mental Health Amendments to 10 USC 1553, a physician with specialized training on mental health disorders was present for this board. The applicant's record of service included four Letters of Reprimand. His misconduct included failure to go on time (3x), departing a building through a fire exit, failure to have mandatory items on person, failure to shave prior to duty, disrespecting an NCO, and lying to NCOs (4x).

The applicant contends that his discharge was inequitable because it was too harsh. He stated that a death in his family caused emotional detachment and mental health issues. After a thorough review of the record, the Board found the applicant did in fact suffer from severe bereavement issues after the passing of his family member. Although the Board does not condone applicant's misconduct , they found sufficient evidence to consider his discharge harsh due to the nexus found between the bereavement and the misconduct of the applicant. As such, the Board grants upgrade of discharge to honorable, change of reason and authority for discharge, and change of reenlistment code.

CONCLUSION: The Discharge Review Board concludes that the discharge was inconsistent with the procedural and substantive requirements of the discharge regulation and finds the applicant was not provided full administrative due process.

Inview of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge. The reason for the discharge is more accurately described as Secretarial Authority and the reenlistment code changed to 3K under the provisions of Title 10, USC 1553.
