| GENERAL: The applicant appeals for upgrade of discharge to honorable change the reason and authority for the discharge, and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDING: The Board grants the upgrade of the discharge and change of reason and authority. The Board however denies change to the re-enlistment code.
ISSUE: Applicant received a general discharge due to misconduct -minor disciplinary infractions
Applicant contends discharge was inequitable because he was immature at the time. The applicant also stated that mother was having medical issues and that the rest of his family was not looking after her like he
thought they would. This caused him distress. The records indicated the applicant received an Article 15 and a Letter of Reprimand for misconduct. His misconduct included refused to continue training in Security Forces Career field and failed to obey order from two SNCOs to return to training. Although the Board does not condone his misconduct, they found the discharge to be too harsh in light of the applicant's short time in service and family problems. The Board grants the upgrade of the discharge and a change to the narrative reason, however the RE code will remain unchanged.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
However, in view of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge and the reason for the discharge is more accurately described as Secretarial Authority under the provisions of Title 10, USC 1553.
