GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FINDING: The Board grants the requested relief.
ISSUE: Applicant received a General discharge for Misconduct -Minor Disciplinary Infractions

The Air Force Discharge Review Board, under its responsibility to examine the propriety and equity of an Applicant's discharge, is authorized to change the character of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presumption, to include evidence submitted by the applicant. The Board did complete a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The Applicant's record of service included ten Letters of Reprimand, two Letters of Counsel, and one Record of Counsel. Her misconduct included departing the local area while on convalescent leave, failure to maintain body fat standards, failure to lose the required one percent body fat within allotted time, financial irresponsibility, failure to wear seatbelt while operating a vehicle on base, failure to return library books, failure to order office forms, and failure to obey dorm rules.

Although not explicitly stated, applicant contends that her discharge had issues of inequity due to the harsh level of disciplinary actions taken against her. After review of the records, the DRB opined that the excessive use of administrative actions created an atmosphere that was not conducive for the applicant to change her negative behavior.

The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process. However, although multiple infractions were noted in member's record, these infractions were of such an insignificant nature, that the Board concludes the overall quality of applicant's service is more accurately reflected by an Honorable discharge.

CONCLUSION: The Board further concludes that an equitable basis for upgrade does exist and determines the service characterization of the discharge will be upgraded to Honorable.
