GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDING: The Board grants the requested relief.
ISSUE: Applicant received a General discharge for Unsatisfactory Performance - Failure to Progress in OJT and Misconduct - Minor Disciplinary Infractions Applicant submitted no issues regarding the inequity or impropriety of her discharge. The applicant does submit that she would like to receive an upgrade to her discharge in order to receive GI Bill benefits. The record indicated the applicant received four Records of Individual Counseling. Her misconduct included failure to obey an order, missed appointment, failure to go (2x), and failure to obey a lawful order. Her unsatisfactory performance included two unsatisfactory scores on her Career Development end of course exams. After a complete and thorough review of the records the Board found the General discharge to be too harsh. The applicant's misconduct was very minor in nature. The Board opinioned that the primary reason for discharge is more appropriately reflected as Unsatisfactory Performance rather than Minor Disciplinary Infractions. The board grants the upgrade of the discharge to honorable.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
However, in view of the foregoing findings, the Board concludes that the overall quality of applicant's service is more accurately reflected by an Honorable discharge and the reason for the discharge is more accurately described as Unsatisfactory Performance under the provisions of Title 10, USC 1553.
