GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but decline and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge.

ISSUE:   Applicant received a General discharge for Misconduct - Drug Abuse (Primary) and A Pattern o Misconduct - Conduct Prejudicial to Good Order and Discipline (Secondary)

Applicant contends discharge was inequitable because it was too harsh and his medical records were no reviewed fully prior to his discharge. The records indicated the applicant was convicted under a Specia Court Martial for being absent from duty for two days, absent from duty for 14 days and use of marijuana or several occasions. Additionally, he received one Article 15, five Letters of Reprimand, and two Letters o: Counseling. This misconduct included slept on duty, fell asleep twice in Class after being counseled, failec to shave, wore a yellow jacket over service dress, failed to go to duty on time (6x), failed to stay attentive ar awake during duty, failed to report to SNCO as instructed and wore wrong rank on uniform.         After complete and thorough review of the records the Board found the applicant's contentions to have no merit The applicant completed a DD Form 2697, Report of Medical Assessment, on 1 July 1999. He did no1 indicate any medical problems and was medically cleared for discharge. Additionally, the Board found nc evidence to indicate that the applicant did not know right from wrong or that in his 11 months of service wm unaware of the Air Force policy of zero tolerance to drug use. The Board found the negative aspects of th<: willful misconduct outweighed the positive aspects of the applicant's performance and concluded that th<:: discharge was appropriate.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
