GENERAL: The applicant appeals to change the reason and authority for the discharge, and to change the reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: After a review of the record, the Board unanimously voted to grant the reliefrequested.

ISSUE:

Applicant contends that she never had a history of a seizure or any other medical problems of this nature.

The member was processed for an administrative discharge based on an erroneous enlistment due to not disclosing a seizure disorder on entry physical. On the applicant's entry physical March 2009, the member denies any history of seizures. In April 2009, on the way to basic training, member has an episode of loss of consciousness, falls, and hits her head. A bystander reported suspected seizures to emergency responders and member was initially disoriented. By the time, the member was taken to the closest emergency room; the member was fully alert and oriented. Civilian diagnosis stated possible syncope or seizures, but there was no evidence of seizure activity on radiological examinations. Multiple visits to military Neurologist after further radiological examinations do not definitively find seizure activity; rather that member could have had a syncopal episode and had a concussion from hitting her head or that seizure activity was present. No history of seizures prior to this one event is noted in the medical records; however, one health provider in October 2009 stated "history of seizure". The Board determined that the member completed her entry physical prior to this one episode of unexplained loss of consciousness, and appropriately answered the questions accurately on her entry physical in March 2009 that she did not have a history of seizure activity. Therefore, the basis of this discharge as an erroneous entry is unsubstantiated.

CONCLUSION: The Discharge Review Board concludes that the discharge was inconsistent with the procedural and substantive requirements of the discharge regulation and finds the applicant was not provided full administrative due process.

In view of the foregoing findings, the Board concludes that the reason for the Honorable discharge received is more accurately described as Secretarial Authority and the reenlistment code changed to 3K under the provisions of Title 10, USC 1553.
