GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant appeared and testified before the Discharge Review Board (DRB), with counsel, at Ft. Gillem
GA, on April 22,2004.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: The Board grants the requested relief.
The discharge is upgraded to General.
The Board finds that neither the evidence of record nor that provided by applicant substantiates an
impropriety that would justify upgrade of the discharge. However, based on the record, the Board finds that
the applicant's character of discharge is inequitable.
ISSUE: After a thorough and complete consideration of the information submitted by the applicant and
contained in the records, the Board concluded there was sufficient mitigation to substantiate upgrade of the
discharge. Specifically, the Board found the characterization was too harsh. The records indicated the
applicant received three Letters of reprimand, and two letters of Counseling. The misconduct included
driving without insurance and lying to supervisors, speeding, disrespect to the police, causing a motor
vehicle accident, having an unregistered vehicle, and dereliction of duty.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
However, in view of the foregoing findings, the Board further concludes that the overall quality of
applicant's service is more accurately reflected by an Honorable discharge.

1. I am recommending your discharge from the United States Air
Force for misconduct. The authority for this action is AFR
39-10, Section H, Paragraph 5-46. If my recommendation is
approved, your service will be characterized as honorable or
general. I am recommending that your service be characterized
as General.
2. My reasons for this action are:
a. On or about 7 Oct 92, you were involved in an accident
while operating a motorcycle without insurance, despite
repeated counselings to cease such activities. When submitting
a statement about this accident, you lied to your supervisor
about the circumstances of the accident, stating that the
accident occurred on a bicycle. For these offenses you
received a letter of reprimand, dated 28 Oct 92, which was
placed in your unfavorable information file (UIF) on 29 Oct 92.
b. On or about 30 Jan 92, you were driving your car at
excessive speeds, and were issued a moving traffic violation by
the local Italian police. The police also took your drivers
license, and reported to your supervisor that you were
disrespectful in words and gestures to the police official on
the scene. For these offenses you received a letter of
reprimand dated 3 Feb 92, which was placed in your UIF on 12
Feb 92. You were also placed on the control roster.
c. On or about 1 Nov 91, you were involved in an accident
while operating a motor vehicle without insurance, despite
previous written counselings to cease such activity. Moreover,
the vehicle was not properly registered, and you failed to
report the accident to the detachment technician on duty, in
violation of standard operating procedure for your detachment.
For these offenses you received a letter of reprimand dated 8
Nov 91, and a UIF was established.
d. On or about 2 Oct 91 you were asked by your supervisor
to show proof of insurance and could not. You had been
operating your vehicle without valid insurance, and were told
at that time to insure your vehicle or cease operating it. For

this offense you received a letter of counseling dated 7 Oct
91.

e. On or about 19 Sep 91, you were assigned to drive the
support run to Vicenza and perform mail clerk duties. You
failed to deliver the mail as directed. Also, you were driving
a GOV while wearing portable headphones, and refused to take
them off when advised of their illegality. For these offenses,
you received a letter of counseling dated 23 Sep 91.
Copies of the documents to be forwarded to the separation
authority in support of this recommendation are attached. The
commander exercising SPCM jurisdiction or a higher authority
will decide whether you will be discharged or retained in the
Air Force. If you are discharged, you will be ineligible for
reenlistment in the Air Force.
3. You have the right to consult counsel. Military legal
counsel has been obtained to assist you. I have made
arrangements for you to maintain telephone contact with
the Aviano Area Defense Counsel, Capt-
134, Phone 7588. Please take the opportunity to contact
counsel as ofiten as necessary. You may consult civilian counsel
at your own expense.

extension for good cause shown. I will send them to the

5. If you fail to consult counsel or to submit statements in

right to do so.
6. You have been scheduled for medical examinations. You must
report to the 401 FW/Clinic, Physical Exam Section at 0945 and
1345 on 9 Nov 92 for the examinatiohs.
7 . Any personal information you furnish in rebuttal is covered
by the Privacy Act Statement as explained in AFR 39-10,
Attachment 2. A copy of AFR 39-10 is available for your use in
the unit orderly room.
8. Execute attached acknowledgment and return to me
immediately.
