MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT: XXX
Having carefully reviewed this application, we agree with the recommendation of the Air
Force office of primary responsibility and adopt the rationale expressed as the basis for our
decision that the applicant has been the victim of either an error or an injustice. Therefore, we
recommend the applicant's records be corrected to show that:
The pertinent military records of the Department of the Air Force relating to XXXX be
corrected to show that:
a. He was exempt from the cardio portion of his 28 February 2011, 31 May 2011,
31 August 2011, and 28 November 2011 Fitness Assessments, resulting in him attaining composite
scores of 85.0 (Good), 81.75 (Good), 96.00 (Excellent), and 96.25 (Excellent), respectively.
b. He was promoted to the grade of airman first class (E-3), effective 26 November
2010 and with a date of rank (DOR) of 9 July 2010.
The applicant has been advised of the recommended relief and finds it full and fitting.

Members must test by the last day of the month, six calendar months following the previous passing test (e.g., if member tested on 15 April, then member must retest on/before 31 October of the same year. The applicant’s last five FA scores are as follows: DATE 10 November 2010 8 February 2011 13 October 2011 * 25 April 2012 24 July 2012 *Contested FA score. The DPSIM complete evaluation, with attachment, is at Exhibit B. While the applicant contends he had been performing physical therapy and rehabilitation from a previous surgery during his FA on 25 Apr 12, we do not find the evidence provided sufficient to conclude that his alleged medical condition precluded him from receiving a fair FA.

Since his 21 April 2010 FA was removed from his record, which was the basis for his demotion action, his rank should be restored. There is no demotion action or demotion order in his personnel records. The applicant contends that his former grade should be restored because his demotion was based upon four consecutive fitness assessment (FA) failures, but one of the four failures was later declared void and removed from his records.
