APPLICANT REQUESTS THAT:
Her records be considered by a Special Board (SB) in lieu of the
Calendar Year 2011 (CY11) Lieutenant Colonel (Lt Col) Position
Vacancy (PV) Promotion Board (U0511B) that was conducted at
Headquarters (HQ) Air Reserve Personnel Center (ARPC) on 13 June
2011.

APPLICANT CONTENDS THAT:
Her records were pulled from the board due to the fact she did
not have a good year; however, based on the provided supporting
documentation, she did have a good year. ARPC used her
Retention/Retirement (R/R) Date of 10 May 2010, which she did
not have a good year due to the fact that she just came from the
Individual Ready Reserve (IRR) after separating from active
duty. This was her last full R/R year prior to the nomination
date of 29 April 2011, but not the “most recent to board convene
date” which was 10 May 2011. She had a good year with 288
points.
In support of her appeal, the applicant provides a personal
statement;

data/service history; an excerpt of Air Force Instruction 36-
2504, Officer Promotion, Continuation, and Selective Early
Removal in the Reserve of the Air Force; her promotion
recommendation; an electronic communication; the CY11 Air Force
Reserve (AFRES) Line and Health Professions Lt Col Promotion
Selection Convening Notice package; and her DD Form 214,
Certificate of Release or Discharge from Active Duty.

STATEMENT OF FACTS:
The applicant is currently serving in the Air Force Reserve in
the rank of major (O-4) with an effective date of 1 June 2006.
She was nominated for a PV promotion opportunity for the Lt Col
Position Vacancy board. Her nomination was received prior to

the suspense date of 29 April 2011 for nomination submissions.
When her records were reviewed for eligibility factors, it was
discovered that she did not meet one of the requirements – R/R
year completed previous to the Board had less than the required
50 points and did not reflect a satisfactory year of federal
service.

service records are contained in the evaluation by the Air Force
offices of primary responsibility at Exhibit B.

AIR FORCE EVALUATION:
ARPC/DPB recommends denial. DPB states that there is a
requirement in Air Force Instruction 36-2504, paragraph 2.7.1,
that indicates the officer must have an outstanding record, with
at least 50 retirement points for a year of satisfactory federal
service during the last full R/R year. ARPC Memorandum (ARPCM)
11-02, dated 18 January 2011, indicates in paragraphs 2 and 4,
that the officer must meet all eligibility requirements as of
the date nominations are due to HQ ARPC, which was 29 April
2011. ARPCM 11-02, PV Nomination Checklist, item 8, indicates
“Previous R/R must have at least 50 points.
On 29 April 2011, the applicant’s current R/R year was
incomplete. Her R/R year runs from 10 May of one year through
9 May of the next. She had not completed the R/R year that
would have closed on 9 May 2011. Her last completed R/R year,
previous to the board, closed out on 9 May 2010 with a total of
35 points, resulting in no satisfactory service for retirement
credit. As a result, she did not have a good year for
retirement and did not meet the eligibility requirement for PV
promotion consideration. Moreover, by Air Force policy, an R/R
year is not credited to an individual’s retirement account until
approximately 60 days after the close out of the R/R year. This
is to allow the addition of late flowing participation, and
removal of any erroneously credited participation. The
applicant’s completed R/R year for 10 May 2010 through 9 May
2011 would have posted to her account and been visible to a
promotion board as a satisfactory year of federal service on
9 July 2011, nearly a month after the board in question
adjourned.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 1 March 2012, for review and comment within 30 days (Exhibit
C). As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or an injustice. We took
notice of the applicant's complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sought in this
application.
4. The applicant's case is adequately documented and it has not
been shown that a personal appearance with or without counsel
will materially add to our understanding of the issues involved.
Therefore, the request for a hearing is not favorably
considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

DPB states, the applicant did not meet the requirement of occupying the nominated position on the PRF submission date, or before the board convened. In reference to #3(b), the letter states the PRF submission was 9 Dec 11. After thoroughly reviewing the evidence of record and the applicant’s complete submission, we do not find the evidence presented sufficiently persuasive to recommend Special Board consideration.
