APPLICANT REQUESTS THAT:

      1.  His Regular Air Force promotion to Lieutenant Colonel (Lt Col)  be
reconsidered by a USAF Reserve supplemental board (U0508A).

      2.  His promotion date to  Lt  Col  be  backdated  to  2  Aug  07,  if
selected.

APPLICANT CONTENDS THAT:

He was selected for promotion to the  grade  of  Lt  Col  while  serving  on
active duty by the Lt Col Central Selection  Board  (P0506C).   However,  he
moved to an Air Force Reserve (AFR) position approximately one  month  prior
to the board results being released.  Due to clerical  errors,  he  was  not
included in the June AFR promotion board.

He would like his Promotion Effective Date (PED)  and  Date  of  Rank  (DOR)
changed to 2 Aug 07 to coincide with the release of Promotion Vacancy  Board
ARPCM 07-11.

In support of  the  application,  he  submits  a  support  letter  from  his
commander, an AF IMT 709,  Promotion  Recommendation,  and  electronic  mail
traffic messages.

His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant was considered and selected for promotion in the  Regular  Air
Force to the grade of Lt Col on 28 Nov 06.  He was assigned line number  603
and would have been promoted to the rank of Lt  Col  effective  and  with  a
date of rank of 1 Feb 08.

He transferred into an Active Guard Reserve (AGR) positionwith the AFR on  2
Feb 07 and is currently serving in the grade of major with a  date  of  rank
of 1 Feb 03.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit B.

AIR FORCE EVALUATION:

HQ ARPC/DPB recommends denial of the applicant's request  for  appeal  board
in lieu of consideration by the FY08 Lt Col Position Vacancy (PV)  promotion
board; however, they recommend adjusting his date of separation from  active
duty to 28 Feb 07, allowing his active duty promotion  to  transfer  to  the
USAFR.

DPB states the applicant has not provided any  indication  that  his  senior
rater supports and desires him to have been considered for promotion by  the
FY08 board.  In addition, there is no memo from the senior rater  indicating
why he was not nominated in time to meet the FY08 board.   Consideration  by
the PV board is only by nomination  of  the  senior  rater;  therefore,  the
applicant has no entitlement or claim to an appeal board.

DPB opines the applicant may not have been  adequately  counseled  prior  to
his separation from active duty.  The P0506C board results were approved  25
days after the applicant separated.  Had he waited the additional days,  his
active duty promotion would have been valid and would have transferred  with
him to the USAFR.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 27 Feb 08, the applicant requested an extension in order  to  obtain  and
provide additional evidence to support his case (Exhibit D).  On 11 Mar  08,
he was advised that his case was being administratively  closed  until  such
time he was ready to proceed (Exhibit E).  In his letter dated  12  Mar  08,
the applicant states his senior rater received his PRF for signature  on  or
about 3 Mar 08.  He  received  a  Definitely  Promote  recommendation;  thus
indicating his  Senior  Rater's  willingness  to  support  his  package  for
consideration by the Jun 07 promotion board (Exhibit  F).   The  applicant's
PRF was received on 14 Mar 08.  On 24 Mar 08, the  applicant  requested  his
case be reopened and his  PRF signed by his senior rater  be  included  with
his case (Exhibit G).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3. Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of an error in regards to his  promotion  to  Lieutenant  Colonel
(LtCol).  Selected for promotion to Lt Col by the  Regular  Air  Force,  it
appears he was not told that if he left the Regular Air Force prior to  the
promotion list being published, that he would not be entitled to  take  the
promotion with him to the Reserve.  His Reserve commander recommended he be
considered for promotion to the grade of LtCol by the AFR  LtCol  PV  Board
that convened in June 2007.  As a result of admitted administrative errors,
his PRF was never forwarded as requested by his commander and  he  did  not
meet  the  June  2007  PV  Board.   The  Air  Force   office   of   primary
responsibility’s (OPR’s) statement that the applicant had not provided  any
indication that his senior rater supported or  desired  him  to  have  been
considered for promotion by the June 2007 PV Board (i.e. a signed PRF – Air
Force Form 709, Promotion Recommendation Form), has been rendered  void  as
his commander has made it clear that he intended for the applicant to  meet
the June 2007 PV Board in a statement provided with a completed PRF.  Thus,
it appears all requirements have been met for his consideration by SSB  as,
if not for the administrative error noted by his commander, he  would  have
been considered by the June 2007 PV Board.  Therefore,  we  recommend  that
the records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force  relating
to APPLICANT be corrected to show that he be considered  for  promotion  to
the grade of lieutenant colonel by a Special Selection Board for the U0508A
, Air  Force  Reserve  Lieutenant  Colonel  Position  Vacancy  Board,  with
inclusion of the attached Promotion Recommendation Form.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he be considered for
promotion to the grade of lieutenant colonel by a Special Selection
Board for the U0508A, Air Force Reserve Lieutenant Colonel Position
Vacancy Board, with inclusion of the attached Promotion Recommendation
Form.
