 RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2011-01071

 COUNSEL: NONE

 HEARING DESIRED: NO

________________________________________________________________

THE APPLICANT REQUESTS THAT:

His Reentry (RE) code of 2C (Involuntarily separated with an
honorable discharge; or entry level separation without
characterization of service) be changed to a code that will
allow him to reenlist in the Air Force.

________________________________________________________________

THE APPLICANT CONTENDS THAT:

Battlefield airman are extremely tough - mentally and physically
with high washout rate jobs; however, he does not believe they
should be discharged for attempting these career fields. He
cannot reenlist with a 2C and would like to be able to serve in
the Air Force in a better fitting job.

The applicant’s complete submission is at Exhibit A.

________________________________________________________________

STATEMENT OF FACTS:

The applicant received an uncharacterized entry level
separation, on 14 Jul 10, for entry level performance and
conduct and a RE code of 2C. He was credited with 3 months and
29 days of active duty service.

________________________________________________________________

THE AIR FORCE EVALUATION:

AFPC/DPSOA recommends denial stating, in part, that the 2C is
the appropriate RE code.

They noted the applicant received an involuntary entry level
separation on 14 Jul 10, after serving 3 months and 29 days of
service with uncharacterized service. He received an RE code of
2C based on his entry level separation with uncharacterized
service. The commander directed the applicant be discharged for
reluctance to make the effort necessary to meet Air Force

standards of conduct and duty performance with an entry level
separation.

The applicant's RE code 2C is required per AFI 36-2606, Reenlistments in the USAF, chapter 3, based on his entry level
separation with uncharacterized service. Per Fiscal Year 2011
(FY11) prior service enlistment program guidance, prior service
personnel with 2C can be given eligibility consideration for
reentry. This consideration for waiver is a recruiter decision
and does not (sic) mean they will be approved for reentry.

The complete AFPC/DPSOA evaluation is at Exhibit C.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the
applicant on 29 Apr 11 for review and comment within 30 days.
As of this date, no response has been received by this office
(Exhibit D.

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by
existing law or regulations.

2. The application was timely filed.

3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

________________________________________________________________

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

On 29 Jan 10, the applicant was notified by his commander that he was recommending his discharge from the Air Force for erroneous enlistment. Although both AFPC/DPSOA and DPSOS recommend denial of relief DPSOA does note the applicant’s RE code is in error, and should be 2C; however, based on the review and recommendation provided by AETC/SGPS we believe his RE code should be changed to 3K, which would afford him the opportunity to apply for enlistment in the armed services.
