APPLICANT REQUESTS THAT: 

 

The effective date on his current promotion order be backdated 
to 26 May 2010, the date the February 2010, major’s list was 
signed.

APPLICANT CONTENDS THAT: 

 

His promotion package was prepared on 2 February 2010, in order 
to arrive at the National Guard Bureau (NGB) for processing on 
his eligibility date of 22 February 2010. The package could not 
be processed because his 2009 and 2010 Officer Performance 
Reports (OPRs) were not signed until 22 April 2010, and this 
delayed his promotion. 

 

The promotion delay was out of his control and cost him months 
of pay. 

 

In support of his request, the applicant provides copies of his 
OPRs, letter of support from his leadership chain, NGB Form 89-
1, Proceedings of a Federal Recognition Examining Board, Special 
Order Number AP-22, and the Officer Retention and Promotion 
Suspense Roster.

STATEMENT OF FACTS: 

 

1. The applicant is currently serving in the Air National Guard 
(ANG) in the grade of major. 

 

2. On 25 January 2011, the applicant was promoted to the grade 
of major, having assumed that grade effective 24 January 2011 
with a date of rank (DOR) of 5 June 2011.

AIR FORCE EVALUATION: 

 

NGB/A1PS recommends approval. A1PS concurs with the NGB Subject 
Matter Expert (SME) advisory, and therefore recommends relief be 
granted. 

 

The complete A1PS evaluation is at Exhibit B. 

 

NGB/A1POP recommends approval. A1POP states that due to an 
administrative error, his initial promotion was held up at the 
unit and state level. Therefore, the applicant’s promotion was 
processed on a later position vacancy list. A1POP concurs with 
the applicant’s request and recommends that his (DOR) be changed 
from 5 June to 22 February 2010, and his promotion effective 
date (PED) be changed from 24 January 2011 to 21 September 2010.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

Copies of the Air Force evaluations were forwarded to the 
applicant on 25 April 2011, for information purposes only 
(Exhibit D).

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by 
existing law or regulations. 

 

2. The application was timely filed. 

 

3. Sufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice to warrant 
partial relief. In this respect, we note that thru no fault of 
the applicant, his promotion to the grade of major was delayed 
for administrative reasons. The applicant requests that his 
promotion effective date (PED) be changed to 26 May 2010 and the 
Air Force office of primary responsibility (OPR) states his PED 
should be changed; however, they recommend his PED be changed to 
21 September 2010, the date the promotion list was actually 
signed/approved by the Secretary of Defense. As such, we agree 
with the OPR that the applicant’s PED and DOR should be 
corrected. Accordingly, we recommend that his records be 
corrected as indicated below.

THE BOARD RECOMMENDS THAT: 

 

The pertinent military records of the Department of the Air 
Force relating to APPLICANT, be corrected to show that he was 
promoted to the grade of major with a promotion effective date 
of 21 September 2010 and date of rank of 22 February 2010.
