APPLICANT REQUESTS THAT: 

 

His Air Force Form 910, Enlisted Performance Report (AB thru 
TSgt), rendered for the period 30 May 07 through 29 May 08, 
Section 3, Fitness, be corrected to reflect "meets standards."

APPLICANT CONTENDS THAT: 

 

In May 2008, the waist measurement taken for the fitness 
assessment was inaccurate. His waist measurement was 42 
inches. On 28 May 08, he entered into the Healthy Living 
Class and his measurement was 39.5 inches. He does not see how 
it is possible to have vastly different measurements in such a 
short time. 

 

In support of his appeal, applicant provides copies of 
documents extracted from his military personnel records.

STATEMENT OF FACTS: 

 

The applicant is currently serving on active duty in the grade 
of staff sergeant. 

 

The remaining relevant facts pertaining to this application, 
extracted from the applicant's military records, are contained 
in the letter prepared by the appropriate offices of the Air 
Force.

AIR FORCE EVALUATION: 

 

AF/A1PP recommends denial. A1PP states that no evidence was 
provided to show the measurement taken on 15 May 08 was 
inaccurate. The applicant did not challenge this measurement 
at the time of the test. His fitness assessment scores from 
2 Apr 04 through 15 May 08 show a pattern of decreased 
performance and his waist measurements reflect a steady 


increase. Further, approving the request would be unfair to 
other airmen who successfully passes his or her fitness 
assessment and every airman who has failed and appropriately 
suffered the consequences of not meeting the Air Force fitness 
standards. 

 

The AF/A1PP complete evaluation is at Exhibit B. 

 

AFPC/DPSIDEP recommends denial. DESIDEP states the applicant has 
not provided any evidence to support the 15 May 08 waist 
measurement was inaccurate. Although, he had a decreased 
measurement of 2.5 inches 13 days after the 15 May 08 
measurement, this does not prove the original measurement was 
inaccurate.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION: 

 

Copies of the Air Force evaluations were forwarded to the 
applicant on 21 Aug 09 for review and comments within 30 days. 
As of this date, no response has been received by this office.

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by 
existing law or regulations. 

 

2. The application was not timely filed; however, it is in 
the interest of justice to excuse the failure to timely file. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or an injustice. We took 
notice of the applicant's complete submission in judging the 
merits of the case; however, we agree with the opinion and the 
recommendation of the Air Force office of primary responsibility 
and adopt its rationale as the basis for our conclusion that the 
applicant has failed to sustain his burden of proof of the 
existence of an error or injustice. Therefore, in the absence of 
evidence to the contrary, we find no compelling basis to 
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT: 

 

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not 
considered with this application.
