APPLICANT REQUESTS THAT:
1. He be awarded the Presidential Unit Citation (PUC) for service at
Nakhon Phanom during the period Mar 72 to Mar 73, and the PUC w/1 Oak
Leaf Cluster (OLC) for service at Korat during the period of Apr 74 to
Nov 74.
2. He be awarded the Republic of Vietnam Gallantry Cross with Palm
for service at Nakhon Phanom from Mar 72 to Mar 73 (Administratively
Corrected).

APPLICANT CONTENDS THAT:
He earned these medals and they were omitted from his records.
In support of the application, the applicant provides a personal
statement and excerpts from his military personnel records.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 15 Mar 71, for a
term of four years, and was progressively promoted to the grade of
sergeant (E-4). On 13 Mar 75, he was honorably discharged for
humanitarian reasons. He served a total of 3 years, 11 months, and 29
days of active duty service.
His records do not reflect award of the PUC.
The PUC is awarded to units of the Armed Forces of the United States
and cobelligerent nations for extraordinary heroism in action against
an armed enemy. This unit must have displayed such gallantry,
determination, and esprit de corps in accomplishing its mission under
extremely difficult and hazardous conditions to have set it apart and
above other units participating in the same campaign.
On 23 Feb 09, AFPC/DPPRSP verified his entitlement to the Air Force
Outstanding Unit Award w/1 Oak leaf Cluster (OLC), the Republic of
Vietnam Gallantry Cross with Palm, and the Vietnam Service medal w/2
Bronze Service Stars.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial. DPSIDR states that after review of the
applicant’s master personnel records, they were able to verify that
the units he was assigned to during the periods in question did not
receive the PUC.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
20 Mar 09, for review and comment within 30 days. As of this date, no
response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
applicant’s submission and the available evidence of record, the Board
was not persuaded that he should be awarded the PUC. We note
AFPC/DPPRSP verified his entitlement to the Air Force Outstanding Unit
Award w/1 Oak Leaf Cluster, the Republic of Vietnam Gallantry Cross
with Palm, and the Vietnam Service Medal w/2 Bronze Service Stars and
his records will be administratively corrected. The Board also notes
there is no evidence to verify the 56th Security Police Squadron or
the 388th Security Police Squadron received the PUC during the periods
the applicant was assigned to those squadrons. As such, he does not
meet the eligibility requirements for the award. In view of this, we
agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for our
conclusion the applicant has not been the
victim of an error or an injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
