He be awarded the Presidential Unit Citation (PUC).

APPLICANT CONTENDS THAT:
The PUC was awarded to the 3rd Reconnaissance Group and his records
should reflect his entitlement to the award.
In support of the application, the applicant provides excerpts from
his military personnel records and documentation related to his
request.

STATEMENT OF FACTS:
The applicant enlisted in the Army 13 Dec 41 for a term of three
years, and was honorably discharged to accept a commission in the Army
Air Corps on 29 Apr 43. He served until 19 Nov 45, when he was
honorably discharged in the grade of first lieutenant.
His records do not reflect award of the PUC.
The PUC is awarded to units of the Armed Forces of the United States
and cobelligerent nations for extraordinary heroism in action against
an armed enemy. This unit must have displayed such gallantry,
determination, and esprit de corps in accomplishing its mission under
extremely difficult and hazardous conditions to have set it apart and
above other units participating in the same campaign.
On 23 Feb 09, AFPC/DPPRSP verified his entitlement to the Air Force
Outstanding Unit Award w/1 Oak Leaf Cluster (OLC), the Republic of
Vietnam Gallantry Cross with Palm, and the Vietnam Service Medal w/2
Bronze Service Stars.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial of the applicant’s request for award of
the PUC. The Distinguished Unit Citation (DUC), now known as the PUC,
was awarded to the 3rd Reconnaissance Group on 28 Aug 44.
DPSIDR indicates that after review of the applicant’s master personnel
records, they were unable to verify he was assigned or attached to the
3rd Reconnaissance Group.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
24 Apr 09, for review and comment within 30 days. As of this date, no
response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
applicant’s submission and the available evidence of record, we are
not persuaded of his entitlement to the PUC. In view of this, we
agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for our
conclusion the applicant has not been the victim of an error or an
injustice. Therefore, in the absence of evidence to the contrary, we
find no compelling basis to recommend granting the relief sought in
this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
