APPLICANT REQUESTS THAT:

The  awarded  Distinguished   Service   Medal   (DSM),   for   exceptionally
meritorious service in a duty of great responsibility  while  distinguishing
himself as Deputy Chief of Staff, Development Plans, Headquarters Air  Force
Systems Command, from 1 December 1973 to 31 May 1976, be  added  to  his  DD
Form 214, Report of Separation from Active Duty.

APPLICANT CONTENDS THAT:

His DD Form 214 is incomplete because the DSM he received in June  1976,  is
not listed and it should correctly reflect all medals he received.

In support of the application, the applicant submits his DD Form 214.

The applicant's complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant was released from active duty on 31 May 1976  and  retired  in
the grade of Brigadier General on 1 June 1976.  He was credited  with  total
active service time of 23 years, 11 months, and 28 days.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPSIDR recommends denial.  DPSIDR  states  the  DSM  is  awarded  to
members who distinguished themselves by  exceptionally  meritorious  service
in a duty of great responsibility.  The recommendation for the DSM  must  be
made by someone  other  than  the  recommended  individual,  preferably  the
commander or supervisor  at  the  time  of  the  act  or  achievement.   The
recommending officer must sign the recommendation and  a  proposed  citation
is required.

DPSIDR notes a Special  Order  was  not  provided  nor  located  within  the
applicant’s official  personnel  file.   Unfortunately,  without  a  Special
Order DPSIDR is not able to  verify  entitlement  to  the  requested  award.
However, should the Board grant the requested relief,  DPSIDR  requests  his
records be appropriately updated to reflect the DSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the award and citation to accompany the award  were  forwarded  by
the applicant’s daughter as proof of receipt of  the  DSM.   The  decoration
was awarded to the applicant on 31 May 76.  He is quite elderly  and  making
his final arrangements.  It is very  important  to  him  to  know  that  his
service is properly recorded.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or injustice concerning the Distinguished  Service  Medal
(DSM).  In this respect, we note the DSM certificate and citation,  provided
by the applicant’s daughter, indicates the decoration was awarded  upon  her
father’s 1 June 1976 retirement culminating a distinguished  career  in  the
service of his country.  Although the applicant has not provided a  copy  of
the order awarding the DSM, we have no reason to doubt the  authenticity  of
the award documents she has provided.  In view of the foregoing,  any  doubt
concerning the DSM should be resolved in  favor  of  the  applicant  and  we
recommend his record be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT  be  corrected  to  show  that  the  DD  Form  214,  Report  of
Separation from Active Duty, issued in conjunction  with  his  31  May  1976
separation,  be  amended  in   Item   26,   Decorations,   Medals,   Badges,
Commendations, Citations and Campaign  Ribbons  Awarded  or  Authorized,  to
include the Distinguished Service Medal (DSM).

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the DD Form 214, Report of
Separation from Active Duty, issued in conjunction with his 31 May 1976
separation, be, and hereby is, amended in Item 26, Decorations, Medals,
Badges, Commendations, Citations and Campaign Ribbons Awarded or
Authorized, to include the Distinguished Service Medal (DSM).
