APPLICANT REQUESTS THAT:

He be awarded the Bronze Star Medal with one oak leaf cluster  (BSM  w/1OLC)
for the period 1 January 1951 through 15 September 1951.

APPLICANT CONTENDS THAT:

He recently found a copy of a recommendation and citation for award  of  the
BSM for distinguished service between 1 January 1951 and 15 September 1951.

In support of his request, the applicant provided  documentation  associated
with his request for replacement of his medals.

The applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant served in the Regular Air Force with 28 years,  8 months,  and
28 days of total active duty service for retirement.

The applicant’s DD Form 214, dated 31 October  1971  indicates  he  received
the following decorations  and  medals:   European  African  Middle  Eastern
Campaign Medal (EAMECM), World War II Victory Medal (WWIIVM),  Distinguished
Unit Citation (DUC), Korean Service Medal  (KSM),  American  Campaign  Medal
(ACM), Army Occupation Medal (AOM), United  Nations  Service  Medal  (UNSM),
Distinguished Unit Citation with One Oak Leaf  Cluster  (DUC  w/1OLC),  Good
Conduct Medal (GCM), Republic of Korea Presidential Unit Citation  (ROKPUC),
Air Force  Longevity  Service  Award  with  Six  Oak  Leaf  Clusters  (AFLSA
w/6OLC), National Defense Service Medal with One Bronze Service  Star  (NDSM
w/1BSS),  Small  Arms  Expert  Marksmanship  Ribbon   (SAEMR),   Air   Force
Outstanding Unit Award (AFOUA), Vietnam Service  Medal  (VSM),  Republic  of
Vietnam Campaign Medal (RVCM), Air Medal  with  One  Oak  Leaf  Cluster  (AM
w/1OLC), Air Medal with  Two  Oak  Leaf  Clusters  (AM  w/2OLC),  Air  Force
Commendation Medal (AFCM), Bronze Star Medal (BSM).

AIR FORCE EVALUATION:

AFPC/DPPPR recommends denial.  DPPPR states the applicant’s  entitlement  to
the MSM, VSM w/2BSS, RVNGC w/P, and the Korean War Service  Medal  has  been
verified and the awards will be added to his separation document.

A special order was located awarding the applicant the  basic  BSM  for  his
service in Vietnam.  A recommendation for  the  BSM  during  the  period  in
question (1951) was provided.  However, an order  approving  the  decoration
from higher headquarters could not be found.

Without conclusive evidence the applicant was approved for  the  BSM,  DPPPR
is unable to determine his entitlement.  The special  order  is  what  makes
the decoration official.  The applicant was only able to furnish a  citation
and recommendation awarding him the MSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 19 May 2006, a copy of the Air Force  evaluation  was  forwarded  to  the
applicant for review and response within 30 days (Exhibit D).   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after reviewing  the  evidence  of  record  along  with  the
applicant’s submission, the majority of the Board agrees  with  the  opinion
and recommendation of the Air Force and adopts its rationale  as  the  basis
for their conclusion that the applicant has not been the victim of an  error
or injustice.  The Board majority notes evidence has not been  provided  and
there is no documentation in  the  applicant’s  military  personnel  record,
which would substantiate that the recommendation for award of  the  BSM  for
the period of 1 January 1951 through 15 September 1951  was  approved.   The
Board majority is not unmindful or unappreciative of  his  service  to  this
Nation and further notes his entitlement to the  MSM,  VSM,  RVNGC  and  the
Korean War Service Medals have been added to his military record.   However,
in the absence of evidence which would  show  to  the  satisfaction  of  the
Board majority his entitlement to the award of  the  BSM  in  question,  the
Board  majority  finds  no  basis  to  favorably   consider   his   request.
Therefore, in the absence of evidence to the contrary,  the  Board  majority
finds no compelling basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The majority of the panel finds insufficient evidence of error or  injustice
and recommends the application be denied.

RECORDS (AFBCMR)

SUBJECT:  AFBCMR Application of XXXXXXXXXXXXX

      I have carefully reviewed the evidence of record and the
recommendation of the Board members.  The majority found that applicant
had not provided sufficient evidence of error or injustice and
recommended the case be denied.  I concur with that finding and their
conclusion that relief is not warranted.  Accordingly, I accept their
recommendation that the application be denied.

      Please advise the applicant accordingly.
