APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty, be corrected to reflect award of the Distinguished Service
Medal with one Oak Leaf Cluster (DSM w/1OLC).

APPLICANT CONTENDS THAT:
He was approved for the DSM w/1OLC; however, due to an oversight
by the personnel section at the time of his retirement, it is not
reflected on his DD Form 214.
In support of his request, the applicant provides a certificate
for award of the DSM w/1OLC and a citation to accompany the
award.

STATEMENT OF FACTS:
The applicant served on active duty in the Air Force from 13 Sep
55 to 30 Jun 89. He was released from active duty and retired in
the grade of major general (0-8) effective 1 Jul 89 after serving
33 years, 9 months, and 18 days on active duty.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial. DPSIDR states a copy of the
applicants citation was located in his military personnel
record. However, without a special order to verify his
entitlement they recommend disapproval.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant states consideration should be given based on the
fact retroactive special orders to verify his entitlement to the
DSM w/1OLC are not available since the issuing personnel office
(San Antonio Air Logistics Center, Kelly AFB, TX) was closed in
2001, due to Base Realignment and Closure (BRAC). He provided
the accompanying citation; this citation was also found in his
records.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. After a
thorough review of the evidence presented, we are persuaded
relief is warranted. The evidence provided, we believe
substantiates the applicants claim that he was recommended for
the DSM 1/OLC and that it was approved up through the chain of
command. We note the DSM 1/OLC certificate is dated 20 Jun 89,
and the applicants date of separation was 30 Jun 89; thus, the
possibility exists that it was not processed in time to be
awarded prior to his separation. Therefore, we believe the
interest of justice can best be served by resolving any doubt in
the applicants behalf. Accordingly, we recommend his records be
corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to the APPLICANT, be corrected to show that the DD Form
214, Certificate of Release or Discharge from Active Duty, issued
in conjunction with his 30 Jun 89 retirement from the Regular Air
Force, be, and hereby is, amended in Block 13, Decorations,
Medals, Badges, Citations, and Campaign Ribbons Awarded or
Authorized, to reflect award of the Distinguished Service Medal
First Oak Leaf Cluster.
