HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
His date of rank (DOR) to captain be changed from 24 Jan 07 to 2 Sep 06.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He was eligible for promotion on 2 Sep 06. He would like his DOR changed
so that future promotions will not be delayed.
In support of his request, the applicant provides an endorsement letter
from his commander and a copy of his promotion orders. The applicant’s
complete submission, with attachments, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System indicates the
applicant’s Total Federal Commissioned Service Date as 2 Sep 04. He is
currently serving in the TN ANG in the grade of captain, with a DOR and an
effective date of 24 Jan 07.
_________________________________________________________________
AIR FORCE EVALUATION:
NGB/A1POP recommends denial. A1POP states that the captain promotion list
was approved by the Secretary of Defense and Public Release was on 24 Jan
07. The DOR and promotion effective date for officers selected for
promotion on the captain's list will be the date the officers complete two
(2) years time in grade or upon Secretary of Defense approval, or upon
public release date, whichever is later. The complete NGB/A1POP evaluation
is at Exhibit B.
_________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was sent to the applicant on 12 Sep 08
for review and comment within 30 days. As of this date, this office has
not received a response.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case and do not find it
supports a determination that the applicant's DOR should be changed. In
this respect, it appears the applicant’s DOR was appropriately established
in compliance with governing directives. Accordingly, in the absence of
evidence showing the applicant was treated differently from others
similarly situated, or that his DOR was established contrary to the
provisions of the governing policy, we find no compelling basis to
recommend granting the relief sought.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

The date of rank for promotion on the captain’s list will be the date the officers complete two years time in grade or upon the Secretary of Defense’s approval, or upon the public release date, whichever is later. Regardless of the fact that the applicant completed two years TIG for promotion on 22 Nov 06, he could not be promoted until 24 Jan 07, the date of public release. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the...

His date of rank to first lieutenant was 20 May 2003. Applicant was eligible for the fiscal year 2006 (FY06) ANG Captain’s Promotion list. ______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that he was promoted to the grade of CAPTAIN, Air Force Reserve, with a Date of Rank (DOR) and a Promotion Effective Date (PED) of 20 May 2005 rather than 1...

DPB states the captain’s promotion list, containing the names of ANG and USAFR officers recommended for promotion, was approved by the Secretary of Defense on 23 January 2007, and ResAF officers began assuming the grade on Public Release of the results, 24 January 2007. No officer is entitled to assume a higher grade until the promotion authority approves that promotion. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its...

She contends her DOR should be the date she became eligible. Air National Guard Instruction (ANGI) 36- 2502, Promotion of Airman, explicitly states that “…the immediate commander must first recommend the airman.” This recommendation must be based on a period of time to allow sufficient evaluation of the member’s performance. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office...

By transferring to the AFR one month before his date of eligibility, he was not included in the AFR promotion process in time to meet the promotion board to captain as would have been directed by ARPCM 02-21. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the...

It is disheartening as he watched his active duty JAG counterparts promoted on time, yet as a Guard JAG he is held to the same standard as far as knowledge, training, and deployments, yet he was promoted more than a year later. There is a requirement that the officer be in an active status for one year prior to submission for promotion on a promotion list, as well as meeting the two year time-in-grade requirement. In this respect, it appears the applicants DOR was appropriately...
