Her date of rank (DOR) to captain be backdated to 28 May 07.

APPLICANT CONTENDS THAT:
She was projected to be promoted to the grade of captain in the Regular
Air Force on 28 May 07, however, she separated on 2 Aug 06, under the
PALACE CHASE Program and joined the Air National Guard (ANG) on 3 Aug
06. She missed the Fiscal Year 2007 (FY07) Captain Promotion Board,
and had to wait until May 07, to meet the FY08 Captain Promotion Board,
where she was selected for promotion. As a result, she was delayed
promotion by over four months past her peers and feels there was no
justification to delay her promotion.

STATEMENT OF FACTS:
The applicant was commissioned a second lieutenant in the Regular Air
Force on 28 May 03, was promoted to the grade of first lieutenant and
separated on 2 Aug 06. She entered the ANG on 3 Aug 06, as a first
lieutenant and was promoted to the grade of captain by the FY08
Captains Promotion Board effective 1 Oct 07.

AIR FORCE EVALUATION:
NGB/A1PS recommends denial. A1PS states, the close-out date for
compiling names for the FY07 Captain’s list was 1 May 06, so she missed
getting on this list and was placed on the next available list, which
was the FY08 Captain’s promotion list. She was selected for promotion
on the FY08 Captain Promotion list. While it is unfortunate that her
transfer from active duty was not in time to place her on the FY07
Captain’s list, all actions taken by the ANG were done correctly.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 11
Jan 08, for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. Evidence has not been provided
which would lead us to believe the rules of the applicable Air Force
Instructions, which implement the law, were inappropriately applied or
that the applicant was denied rights to which entitled. Therefore, the
Board agrees with the opinion and recommendation of the Air Force
office of primary responsibility and adopts its rationale as the basis
for our conclusion that the applicant has not been the victim of an
error or injustice. In the absence of persuasive evidence to the
contrary, we find no basis to recommend granting the relief sought in
this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice; that
the application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly

In February 2007, the applicant was considered but was not selected for promotion by the FY08 Reserve Major Promotion Board. She ended up meeting the promotion board in the same Category E position as the first board. DPB states there is no apparent error in her Officer Selection Record (OSR) that could result in Special Selection Board (SSB) consideration in lieu of either the FY07 or FY08 USAFR Major Promotion Boards.
