APPLICANT REQUESTS THAT:
He be awarded the United States Air Force Combat Action Medal (AFCAM) with
Valor.

APPLICANT CONTENDS THAT:
The award criteria has been met due to multiple enemy engagements of
surface to air missiles and anti-aircraft fire during multiple combat
missions during operations IRAQI FREEDOM and ENDURING FREEDOM. Proof of
such incidents is recorded in five awarded Air Medals and the USAF 2005
Cheney Award.
In support of his request, the applicant provided an AF IMT 3994
(Recommendation for Decoration Deployment/Contingency Operations) dated 17
January 2008, The Cheney Award for 2005, four Air Medals dated 19 March
2003; 21 July 2003, 16 August 2005, and 18 November 2005, and two
Commander letters; one undated and one dated 22 August 2006.

STATEMENT OF FACTS:
The applicant received The Cheney Award for 2005 and five Air Medals, dated
19 March 2003; 21 July 2003, 16 August 2005, and 18 November 2005, for
meritorious achievement while participating in aerial flight.
IAW DoD 1348.33M dated September 1996 and AFI 36-2803 dated 15 June
2001, the SECAF approved establishment of the AFCAM on 15 March 2007 to
recognize any military member of the Air Force (Airman Basic thru Colonel),
who actively participated in either air or ground combat. The principle
eligibility criterion is that the individual must have been under direct
and hostile fire while operating in unsecured space (defined as outside the
defended perimeter), or physically engaging hostile forces with direct and
lethal fire. The Commander, Air Force Forces (COMAFFOR) is the award
authority for the AFCAM. The award criteria for the AFCAM are similar to
that of other United States Services but are more specific with regard to
combat conditions criteria.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial. DPSIDR states that on 10 June 2008 they
were informed that USCENTAF disapproved the request for award of the AFCAM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 27
June 2008 for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We carefully considered the applicant's
complete submission in judging the merits of the case; however, we find no
evidence of an error or injustice warranting corrective action. In this
respect, the applicant has not provided evidence showing that the
determination of USCENTAF. i.e., that there is no evidence showing that any
of the engagements he was involved in met the criterion for award of the
AFCAM was made in error and we are not persuaded by his assertions of the
existence of an injustice in this case. Accordingly, absent other
persuasive evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the
submission of newly discovered relevant evidence not considered with this
