APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Armed Forces
Expeditionary Medal (AFEM) for service he performed in Lebanon and Grenada.

APPLICANT CONTENDS THAT:
He served during the Lebanon and Grenada crisis. He took the Border Patrol
exam and needs the AFEM to show proof of his eligibility to receive his
veteran's preference points. He is presently working for Homeland Security
but wants to be promoted to Border Patrol.
In support of his application, the applicant submits his DD Form 214 and an
excerpt from the Office of Personnel Management application.

STATEMENT OF FACTS:
On 6 May 85, the applicant was separated from active duty service in the
grade of airman first class with a general (under honorable conditions)
discharge for misconduct-pattern of minor disciplinary infractions. He
served 3 years, 9 months and 29 days to include 1 year, 11 months and 23
days of overseas duty.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial. DPSIDR states campaign medals are
awarded to service members who have participated in a United States
military operation. The applicant was serving on active duty and not in
direct support of an operation; therefore, he is ineligible to receive a
campaign medal.
DPSIDR notes the applicant served on active duty from 8 Jul 81 to 6 May 85.
The Directorate of Assignments was unable to verify the applicant served
in Lebanon or Granada.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 21 Dec
07 for review and comment within 30 days. As of this date, this office has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Other than his own assertions, the
applicant has provided no documentary evidence that would establish his
entitlement to the Armed Forces Expeditionary Medal; therefore, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. While we
appreciate and honor the applicant’s service to his country, in view of the
above and in the absence of evidence we have no basis on which to favorably
consider this request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
