APPLICANT REQUESTS THAT:

His date of rank (DOR) be changed to 30 Jul 02, rather than 1 Oct 02.

APPLICANT CONTENDS THAT:

He was already promoted to major when he was assigned to  the  313th  Flight
Test Flight.  His commander inquired about accelerating  his  promotion  and
was erroneously informed that it was not possible.  As a result, he was  not
promoted until the next fiscal year.

In support of his  application,  he  submitted  a  recommendation  from  his
commander, a copy of  his  AF  Form  1288,  Application  for  Ready  Reserve
Assignment, and AF Form 4007,  Request  and  Authorization  of  Reassignment
Orders.

STATEMENT OF FACTS:

The applicant is currently serving in the Air Force Reserves  in  the  grade
of major.

He was considered and selected for promotion to major  by  the  Fiscal  Year
2003 (FY03) Line and Health Professions Major (SelRes)  Promotion  Selection
Board, which convened February 2002.  The results  were  released  in  April
2002.

AIR FORCE EVALUATION:

ARPC/DPB  recommends  the  requested  relief  be  denied.  DPB  states   the
applicant was assigned to the 313th Flight Test Flight  on  2 Aug  02.   The
assignment orders he submitted reflects his EDCSA (estimate date  change  in
strength accountability) is 2 Aug 02.
His duty qualification history brief reflects his date of  assignment  as  2
Aug 02.

Although his current commander supports  accelerating  his  promotion  under
Air Force Instruction (AFI) 36-2504, Promotion, Continuation  and  Selective
Early Removal in the Reserves of the Air Force, paragraph  6.5;  his  senior
rater has not, as required by the AFI, endorsed  the  change.   His  current
chain of command is not the chain of command  that  existed  in  2002.   His
previous rater has not provided any statements indicating  they  were  given
bad advice concerning  accelerated  promotion  or  that  they  believed  the
applicant was deserving of a promotion in August 2002.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 12  Oct
07 for review and comment within 30 days.  As of this date, this office  has
received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an error or an injustice.   Applicant’s  contentions  are  duly
noted; however, we agree with the opinion  and  recommendation  of  the  Air
Force and adopt its rationale as the  basis  for  our  conclusion  that  the
applicant  has  not  been  the  victim  of  an  error  or   injustice.    No
documentation has been provided  by  the  applicant’s  previous  command  to
indicate that they are in support of his request; or that  they  were  given
erroneous information regarding accelerated promotion.   Therefore,  in  the
absence of evidence  to  the  contrary,  we  find  no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the
submission of newly discovered relevant evidence not  considered  with  this
application.
