APPLICANT REQUESTS THAT:

His records be corrected to reflect the  award  of  the  Small  Arms  Expert
Marksmanship Ribbon with Bronze Service Star (SAEMR w/BSS).

APPLICANT CONTENDS THAT:

He qualified as an Expert with the M-16 rifle on 4 Nov 68 and on  5  Nov  68
with  the  Smith  and  Weston  Combat   Masterpiece   K-38   pistol.    Both
qualifications took place during the Weapons and  Field  Training  Block  of
his Security Police training.

STATEMENT OF FACTS:

On 17 May 72, the applicant was honorably discharged in the grade  of  Staff
Sergeant.  He had served 3 years, 8 months and 22 days on active duty.

AIR FORCE EVALUATION:

HQ AFPC/DPSIDR recommends denial.  DPSIDR states the  SAEMR  is  awarded  to
all military service members who after 1 Jan  63,  qualify  as  "expert"  in
small-arms marksmanship with either the M-16 rifle or issue handgun.   After
a through review of the applicant's military record, DPSIDR  was  unable  to
locate documentation which verified he was qualified or awarded the SAEMR.

The DPSIDR evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 11  Jan
08 for review and comment within 30 days.  As of this date, this office  has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error  or  injustice.   Other  than  his  own  assertions,  the
applicant has provided no documentary  evidence  that  would  establish  his
entitlement to  the  Small  Arms  Expert  Marksmanship  Ribbon  with  Bronze
Service Star; therefore, we agree with the  opinion  and  recommendation  of
the Air Force office of primary responsibility and adopt  its  rationale  as
the basis for our conclusion that the applicant has not been the  victim  of
an error or injustice.   While  we  appreciate  and  honor  the  applicant’s
service to his country, in view of the above and in the absence of  evidence
to the contrary we have  no  basis  on  which  to  favorably  consider  this
request.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
