APPLICANT REQUESTS THAT:

His date of rank (DOR) be corrected.

APPLICANT CONTENDS THAT:

His DOR is incorrect because he was not credited for 18.5 months  time
in grade (TIG) as an airman first class.


In support of his request, applicant provided a copy of DD  Form  214,
Certificate of Release or discharge from Active Duty, Letter from  Air
Education and Training Command, Military Personnel Flight Printouts, a
Personal Statement, AF Form 973, Request and Authorization for  Change
of Administrative Orders, excerpts from his military personnel records
and a copy of DD Form 1966/3, Record of Military  Processing  –  Armed
Forces of the United States.

STATEMENT OF FACTS:

The applicant enlisted in Regular Air Force on 17 Jun 03, as an airman
basic and separated on 15 Dec 04,  as  an  airman  first  class  after
completing 1 year, 5 months and  29  days  active  duty  service.   He
enlisted into the Reserves on 15 Dec 04, and separated on  24 Aug  06,
in the grade of senior airman.  He then enlisted into the Regular  Air
Force on 25 Aug 06, as an airman first class.

AIR FORCE EVALUATION:

AFPC/DPSOAA recommends denial.  DPSOAA states in part,  the  applicant
did not hold 24 months total active federal military  service  (TAFMS)
prior to his return to active duty, therefore his DOR is his  extended
active duty date of 25 Aug 06.  Prior enlistment, as defined in AFI 36-
2606, Reenlistment in the United States Air  Force,  is  a  period  of
federal military service during which a member completed 24 months  or
more active duty before entry into  the  current  Regular  Air  Force.
When he separated from active duty on 15 Dec  04,  he  had  1  year  5
months and 29 days of active duty service.  Per AFI  36-2604,  Service
Dates and Dates of Rank, he  is  classified  as  a  non-prior  service
member.  Therefore, his DOR should be his date of enlistment into  the
Regular Air Force, which was 25 Aug 06.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
21 Sep 07 for review and comment within 30 days.  As of this date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of an  error  or  injustice.   We  took  notice  of  the
applicant’s complete submission in judging the  merits  of  the  case;
however we agree with the opinion and recommendation of the Air  Force
office of primary responsibility and adopt it’s rationale as the basis
for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  Therefore, in the  absence  of  evidence  to  the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
