ADDENDUM TO
RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2007-01980
INDEX CODE: 128.05
XXXXXXX COUNSEL: NONE
HEARING DESIRED: NO
________________________________________________________________
APPLICANT REQUESTS THAT:
1. His Date of Separation (DOS) be changed to reflect the correct DOS.
2. His records be corrected to reflect he is entitled to a Selective
Reenlistment Bonus (SRB).
________________________________________________________________
STATEMENT OF FACTS:
On 6 April 2005, the applicant submitted an application to the Board
requesting he be given a SRB in conjunction with his 13 October 2004
reenlistment.
On 14 July 2005, the Board considered and denied his request. For an
accounting of the facts surrounding his previous request and the rationale
of the Board's earlier decision, see the Record of Proceedings at Exhibit
F.
On 10 May 2007, the applicant requested the Board change his DOS to reflect
12 October 2008 and to reconsider his request that he receive an SRB. He
provided excerpts from AFI 36-2101, Classifying Military Personnel (Officer
and Enlisted), copies of his enlistment/reenlistment documents and data
extracted from AFPC’s website. His complete submission, with attachments,
is at Exhibit G.
________________________________________________________________
AIR FORCE EVALUATION:
HQ AFPC/DPPAE recommends denial. DPPAE states the applicant entered the
Air Force on 16 January 2001 for a period of four years. This established
his DOS as 15 January 2005. On 13 October 2004, he reenlisted for a period
of five years and six months. This reenlistment established a new DOS of
12 April 2010. However, the correct obligated service was three months;
therefore, his actual reenlistment should have been for five years and
three months. Based on the actual reenlistment and obligated service he
has a correct DOS of 12 January 2010. This DOS is currently reflected in
the Military Personal Data Systems (MILPDS) and on Defense Finance
Accounting Service files. The Board should direct his DD Form 4/1,
Enlistment/Reenlistment Document, Armed Forces of the United States be
corrected to reflect the reenlistment of five years and three months vice
the current contract of five years and six months. MILPDS and DFAS files
reflect the reenlistment of five years and three months for a DOS of 12
January 2010. There is no evidence to support the requested DOS of 12
October 2008.
The complete DPPAE evaluation is at Exhibit H.
________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant responded stating he does not wish to change his DOS to 12
October 2008 as stated in the advisory. He sent paperwork stating he had
the wrong DOS on record. He states the Board agreed and changed his DOS to
12 October 2008 when it should have been 16 January 2009.
His complete response, with attachments, is attached at Exhibit I.
________________________________________________________________
THE BOARD CONCLUDES THAT:
After reviewing this application and the evidence provided in support of
his appeal, we are not persuaded that the applicant’s DOS should be changed
nor are we persuaded that he should have been authorized an SRB. We
carefully considered the information provided by the applicant. However,
while the information he obtained from the VMPF listed incorrect
information, his enlistment contract contains the correct information and
is consistent with the data in the military personnel data system. In
regards to his request for an SRB, the applicant accepted retraining into
the Communications Career Field and as a result, he waived all rights to
the SRB in his previous career field. Absent persuasive evidence to the
contrary we find no compelling basis to recommend favorable consideration
of his application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of error or injustice; that the
application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
