APPLICANT REQUESTS THAT:
He be awarded of the Purple Heart (PH) medal for an injury he incurred in
Germany.

STATEMENT OF FACTS:
A similar appeal was considered and denied by the Board on 18 Apr 06. For
an accounting of the facts and circumstances surrounding his previous
request, and the rationale for the earlier decision by the Board, see the
Record of Proceedings, with attachments, at Exhibit E.
In his request for reconsideration, the applicant states the Department of
Veterans Affairs (DVA) states his records reflect he was in combat and
received the PH for a shrapnel wound in Germany in March 1945. His
complete submission, with attachments, is at Exhibit F.
A Compensation and Pension Exam Report dated 2 May 07 notes he incurred an
injury to his right leg from shrapnel, that he was not hospitalized but
treated on the spot (Exhibit G).

THE BOARD CONCLUDES THAT:
After again reviewing this application, we believe sufficient evidence
exists to support award of the PH. In this respect, we note the
applicant's military records contain a report of physical examination
completed on 4 Sep 45, which indicates he was wounded in action with a
shrapnel wound in Germany. The report also contains the annotation "Purple
Heart." While this particular annotation appears to be improperly placed
on the form, the fact that it was annotated on the form leads us to believe
that the applicant has established reasonable doubt as to whether he was
awarded the PH at the time his injury was incurred. Accordingly, it is our
opinion that any doubt in this matter should be resolved in his favor and
we recommend his records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to the APPLICANT be corrected to show that on 15 November 1946, he was
awarded the Purple Heart for injuries sustained as a direct result of enemy
action while serving in Germany.

Having reviewed and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116) it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected to show that on 15 November 1946, he
was awarded the Purple Heart for injuries sustained as a direct result of
enemy action while serving in Germany.

He has been trying to secure his entitlement to this PH for 40 years, and all he has been told is that the Veterans Administration (VA) has his records but does not have time to provide them to the Board and they will get to it when they can. He had a very good record, was always there, was never sick, and cannot get a copy of his records sent to the Board because of some lazy people in the VA. If the applicant can provide such evidence, we will reconsider his application.
