His records be corrected to reflect award of the Purple Heart (PH) medal.

STATEMENT OF FACTS:
A similar appeal was considered and denied by the Board on 6 Feb 08. For
an accounting of the facts and circumstances surrounding his request, and
the rationale for the earlier decision by the Board, see the Record of
Proceedings, with attachments, at Exhibit E.
In his most recent submission the applicant provided photographs, a piece
of shrapnel, and a detailed account of the rocket attack at Phu Cat Air
Base, Vietnam in May 1968. His complete submission, with attachment, is at
Exhibit F.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice to warrant corrective action. After
reviewing the documentation submitted, the Board majority believes the
applicant has provided sufficient evidence to establish reasonable doubt as
to whether his injury was incurred as a direct result of enemy fire. In
view of the above the Board majority believes any doubt in this matter
should be resolved in favor of the applicant. Therefore, the Board
majority recommends his records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to the APPLICANT be corrected to show that he was awarded the Purple Heart
(PH) for injuries sustained as a direct
result of enemy action while serving at Phu Cat Air Base, Vietnam in May
1968.

Having reviewed and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116) it is directed that:
The pertinent military records of the Department of the Air Force
relating to be corrected to show that he was awarded the Purple Heart
(PH) for injuries sustained as a direct result of enemy action while
serving at Phu Cat Air Base, Vietnam in May 1968.

He has been trying to secure his entitlement to this PH for 40 years, and all he has been told is that the Veterans Administration (VA) has his records but does not have time to provide them to the Board and they will get to it when they can. He had a very good record, was always there, was never sick, and cannot get a copy of his records sent to the Board because of some lazy people in the VA. If the applicant can provide such evidence, we will reconsider his application.
