APPLICANT REQUESTS THAT:

He be awarded the Air Force Good  Conduct  Medal  (AFGCM)  and  the
Small Arms Expert Marksmanship Ribbon (SAEMR).

APPLICANT CONTENDS THAT:

The decorations were awarded in 1970.

Applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:

Applicant enlisted in the Regular Air Force on  21  Apr  67  for  a
period of four years in the grade of airman basic (E-1/AB).  He was
progressively promoted to the grade of SSgt with a date of rank  of
1 Jan 71.  Applicant served as  an  Aircraft  Electrical  Repairman
(AFSC 42350).

On 14 Apr 71, applicant was honorably released from active duty and
transferred to the United States Air Force Reserve (USAFR).  He was
credited with 3 years, 11  months,  and  24  days  of  active  duty
service (including 3 years,  3  months,  and  27  days  of  foreign
service).

DD Form 214, Armed Forces of the United States Report  of  Transfer
or Discharge, reflects award of the Air  Force  Commendation  Medal
(AFCM), National Defense  Service  Medal  (NDSM),  Vietnam  Service
Medal (VSM), and the Republic of Vietnam Campaign Medal (RVCM).

On 20 Apr 73, applicant was honorably discharged from the Air Force
Reserve and furnished an honorable discharge certificate.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR reviewed this application  and  recommended  approval
for award of the AFGCM and noted that  his  DD  Form  214  will  be
corrected administratively.  They were unable to locate evidence of
the  applicant  ever  being  awarded  the  SAEMR.    The   required
AF Form 522 Small Arms Expert Marksmanship Training  Data  was  not
located in the record nor submitted by the applicant to verify  his
eligibility for the SAEMR.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  the  applicant
on 15 Jun 07 for review and comment within 30  days.   As  of  this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing
law or regulations.

2.  The application was not timely filed; however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient  relevant   evidence   has   been   presented   to
demonstrate the existence of error or injustice.  We took notice of
the applicant's complete submission in judging the  merits  of  the
case; however, we agree with the opinion and recommendation of  the
Air  Force  office  of  primary  responsibility  and  adopt   their
rationale as the basis for our conclusion that  the  applicant  has
not been the victim of an error or injustice.  Applicant’s  records
were thoroughly reviewed,  however,  no  documents  were  found  to
substantiate his eligibility for award of  the  Small  Arms  Expert
Marksmanship Ribbon.  In view of the above, we  find  no  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified  that  the  evidence  presented  did  not
demonstrate the existence of material error or injustice; that  the
application was denied without a personal appearance; and that  the
application will only be reconsidered upon the submission of  newly
discovered relevant evidence not considered with this application.
