APPLICANT REQUESTS THAT:
He be awarded the Vietnam Service Medal (VSM).

APPLICANT CONTENDS THAT:
He served in Thailand in 1973, and is now disabled and would like to
join the Veterans for Foreign Wars (VFW). He states the medal has no
monetary effect on anyone.
His complete submission is at Exhibit A.

STATEMENT OF FACTS:
Applicant’s military personnel records reflect he served on active
duty from 23 Feb 72 through 20 Feb 76.
On 20 Feb 76, he was honorably discharged in the grade of sergeant (E-
4). He served 3 years, 11 months and 28 days of total active service.
The VSM is awarded to all service members of the Armed Forces who
between 4 Jul 65 and 28 Mar 73, served in the following areas of
Southeast Asia; in Vietnam, and the contiguous waters and airspace; in
Thailand, Laos or Cambodia or the airspace thereof and in direct
support of military operations in Vietnam.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. DPPPR states the applicant’s tour in
Thailand started in Sep 73; therefore, based on the criteria, he is
ineligible for award of the VSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 9
Mar 07 for review and comment within 30 days. As of this date, this
office has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
available evidence and the applicant’s complete submission, the Board
is not persuaded his records should be corrected to show he was
awarded the (VSM). The Board took notice of the applicant's complete
submission in judging the merits of the case; however, the Board
agrees with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for their
conclusion that the applicant has not been the victim of an error or
injustice.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate
the existence of material error or injustice; the application was
denied without a personal appearance; and the application will only be
reconsidered upon the submission of newly discovered relevant evidence
not considered with this application.
