APPLICANT REQUESTS THAT:
His records be corrected to reflect award of Army Good Conduct Medal
(GCM), National Defense Service Medal (NDSM), Korean Service Medal
(KSM), Rifle Ribbon and the Berlin Airlift.

APPLICANT CONTENDS THAT:
He was in Korea from 1948 through 1952. He did not list any other
contentions.
In support of his appeal, applicant submitted a copy of his DD Form
214.
Applicant's complete submission, with an attachment, is attached at
Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force (RegAF) on 8 January
1948, in the grade of private (Pvt) for a period of three years. He
was honorably discharged on 7 January 1952.
The applicant’s WD AGO Form 24A, Service Record reflects the applicant
had an overseas assignment to Liverpool, England from 23 September
1948 to 23 March 1951.
On 2 May 1958, a DD Form 215 was issued adding the GCM, NDSM and the
Medal for Humane Action to the applicant’s DD Form 214.
On 24 January 2007, a DD Form 215 was issued to add the Army
Occupational Medal with Berlin Aircraft Device (AOM w/BAD), Air Force
Longevity Service Award (AFLSA) and the Army Weapons Qualification-
Rifle to his DD Form 214. Therefore, the only remaining issue for
consideration by the Board is the KSM.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends the requested relief be denied. They state
the KSM was awarded to servicemembers for service between 27 June 1950
and 27 July 1954 within the territorial limits of Korea in waters
immediately adjacent thereto; or with a unit under the operational
control of the Commander-in-Chief, Far East, other than those units
within the territorial limits of Korea, which has been designated by
the Commander-in-Chief, Far East, as having directly supported the
military efforts in Korea; or was furnished an individual certificate
by the Commander-in-Chief, Far East, testifying to material
contribution made in direct support of the military efforts in Korea.
AFPC/DPPPR further states the applicant’s overseas assignment was in
England and therefore he is not eligible for the KSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 2
February 2007, for review and response. As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. As stated, the applicant’s
records were administratively corrected in 1958 to add the GCM, NDSM,
Medal for Humane Action to his DD Form 214. The applicant’s
eligibility for the AOM w/BAD, AFLSA and the Army Weapons
Qualification-Rifle has been verified and his records will be
corrected administratively to add these medals to his DD Form 214. We
took note of the documentation the applicant provided in support of
his request for award of the KSM, however, the Board agrees with the
opinion and recommendation of the Air Force and adopts its rationale
as the basis for our decision that the applicant has failed to sustain
his burden that he has suffered either an error or an injustice.
Therefore, in the absence of the evidence to the contrary, the Board
finds no compelling basis to recommend granting the relief sought in
this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

HQ AFPC/DPPPR verified the applicant’s entitlement to the GCM w/BL, ROKPUC and his records will be corrected administratively to add the awards. The applicant did not provide any documentation to verify his entitlement to the PUC and the KSM w/1 SSS and 3 BSS. On 21 September 2006, the Board staff forwarded the applicant a corrected copy of the Air Force evaluation for his review and response.

Army Regulation 600-8-22 (Military Awards) states the KDSM is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea. The FSM was awarded the VSM, and his records show he participated in four campaigns while serving in Vietnam. The evidence of record shows the applicant was awarded the KSM, but does not show he received campaign credit for service in Korea.

Applicant’s official record reveals that he served in Japan, from 15 Nov 50 to 7 Jan 51, not in Korea. After a thorough review of the applicant’s submission and the available evidence of record, we are not persuaded that the relief requested should be granted.
