THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant, the daughter of a deceased former service member (FSM), requests correction of the FSM's record to show he is authorized the following:

* "Republic of Korea Korean Service medal" (taken to mean the Republic of Korea War Service Medal (ROKWSM))
* Republic of Korea Presidential Unit Citation (ROKPUC)
* National Defense Service Medal (NDSM)
* one additional bronze service star for his previously-awarded Korean Service Medal (KSM)
* any other awards he may be entitled to receive

2.  She states:

* the FSM did not receive the ROKWSM because it was awarded retroactively in 1999
* he did not receive the ROKPUC following its expansion to all U.S. units that served in Korea
* he never received the NDSM
* he served in Korea from approximately January through October 1952 during two campaigns:  Second Korean Winter and Korea Summer-Fall 1952




3.  She provides:

* Certificate of Live Birth
* Certificate of Marriage
* Certificate of Death
* DD Form 214 (Report of Separation from the Armed Forces of the United States)
* Orders
* WD AGO Form 53-98 (Military Record and Report of Separation - Certificate of Service)
* WD AGO Form 53-55 (Enlisted Record and Report of Separation - Honorable Discharge)

CONSIDERATION OF EVIDENCE:

1.  On 29 June 1943, the FSM was inducted into the Army of the United States (AUS).  On 14 July 1943, he entered active duty.  On 18 May 1945, he was honorably discharged to accept an appointment as a second lieutenant (2LT).  

2.  The WD AGO Form 53-55 documenting his enlisted service shows in:

* item 33 (Decorations and Citations) – Army Good Conduct Medal (AGCM)
* item 37 (Total Length of Service) – 1 year, 10 months, and 20 days of continental service and no foreign service

3.  On 19 May 1945, he took the oath of office as a 2LT in the AUS.  On 8 March 1947, he was relieved from active duty as a first lieutenant in the Infantry Branch.  The WD AGO Form 53-98 documenting this period of service shows in:

   a.  item 29 (Decorations and Citations): 

* Army of Occupation Medal (AOM)
* Asiatic-Pacific Campaign Medal
* World War II Victory Medal

   b.  item 32 (Service Outside Continental U.S. and Return) – he served in the Asiatic-Pacific Theater from 29 October 1945 to 22 December 1946.

4.  A WD AGO Form 100 (Separation Qualification Record) shows he served in Korea in 1945 and 1946.

5.  After he was relieved from active duty in 1947, he continued to serve in the Officers' Reserve Corps.  Effective 14 July 1951, he was ordered to active military service for a period of 21 months.  

6.  A WD AGO Form 66 (Officer's, Warrant Officer's Qualification Card) shows in:

* item 26 (Foreign Service Data) – he served in Korea from 20 February to 28 September 1952
* item 28 (Chronological Record of Military Service) – during his service in Korea he was assigned to the 38th Infantry Regiment from 3 March to 
23 September 1952 
* item 40 (Qualification in Arms) – he qualified as an "Expert" with the M-1 Rifle

7.  On 9 April 1952, Headquarters, 38th Infantry Regiment, issued Special Orders Number 91 awarding him the Combat Infantryman Badge (CIB).

8.  On 7 November 1952, he was honorably released from active duty.  His DD Form 214 shows he was awarded or authorized the:

* Army Commendation Medal
* KSM with one bronze service star
* United Nations Service Medal

9.  On 19 February 1953, his resignations from his commission in the Officers' Reserve Corps and the AUS were accepted.

10.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.

	a.  Paragraph 2-10 states the NDSM is awarded for honorable active service for any period between 27 July 1950 and 27 July 1954.  

	b.  Paragraph 5-9 states a bronze service star is authorized for wear with the KSM for each campaign during which a Soldier was assigned or attached to and present for duty with a unit during the period in which it participated in combat.  The Korea campaigns are listed in appendix B.  The FSM's service in Korea coincided with two campaigns:  Second Korean Winter (28 November 1951 to
30 April 1952) and Korea Summer-Fall 1952 (1 May to 30 November 1952).  

	c.  Paragraph 5-11 states the AOM is awarded for service of 30 consecutive days at a normal post of duty in a qualifying location.  The award is authorized for service with the Army of Occupation of Korea between 3 September 1945 and 29 June 1949.  Soldiers who served in the Far East Theater during the occupation of the Far East will wear the clasp inscribed "Japan."

	d.  Paragraph 5-15 states the American Campaign Medal (ACM) is awarded for qualifying service in the American Theater between 7 December 1941 and 2 March 1946.  Qualifying service for this campaign medal includes service within the continental United States for an aggregate period of 1 year.

	e.  Paragraph 8-47 states a basic marksmanship qualification badge is awarded to indicate the degree – Expert, Sharpshooter, and Marksman -- in which an individual has qualified in a prescribed record course.  An appropriate bar is furnished to denote each weapon with which the individual has qualified.

	f.  Paragraph 9-16 states the ROKWSM is awarded to members of the U.S. Armed Forces who served in Korea and adjacent waters between 25 June 1950 and 27 July 1953.  The service must have been performed, in part, while on permanent assignment or on temporary duty for 30 consecutive or 60 non-consecutive days within the territorial limits of Korea or the waters immediately adjacent thereto.

11.  Department of the Army Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) shows the FSM was assigned to the 38th Infantry Regiment during a period for which the unit was awarded the ROKPUC by Department of the Army General Order Number 10, dated 1954.

DISCUSSION AND CONCLUSIONS:

The evidence shows the FSM is entitled to several awards that are not listed on his DD Form 214.  It would be appropriate to amend the DD Form 214 to show all awards he is authorized as described below.

	a.  The FSM completed periods of service qualifying for award of the:

* NDSM
* ACM
* ROKWSM

	b.  He was awarded the KSM and he participated in two campaigns.  Therefore, he is entitled to two bronze service stars for wear on his previously-awarded KSM.

	c.  He served in the Army of Occupation of Korea and he was awarded the AOM.  He is entitled to the Japan Clasp for wear with the AOM.
	d.  He was awarded the CIB.  

	e.  He was awarded the AGCM, Asiatic-Pacific Campaign Medal, and World War II Victory Medal.

	f.  He qualified as an "Expert" with the M-1 Rifle.  Therefore, he is entitled to the Expert Marksmanship Qualification Badge with Rifle Bar.

	g.  He served in a unit during a period in which the unit was awarded the ROKPUC.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows:

	a.  deleting the KSM with one bronze service star; and

	b.  adding the:

* AGCM
* NDSM
* KSM with two bronze service stars
* AOM with Japan Clasp
* ACM






* Asiatic-Pacific Campaign Medal
* World War II Victory Medal
* ROKWSM
* CIB
* Expert Marksmanship Qualification Badge with Rifle Bar
* ROKPUC
