ADDENDUM TO
RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2002-03011-2
INDEX CODE: 137.04
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
Corrective action be taken that would permit him to increase his base
amount under the Survivor Benefit Plan (SBP) from a reduced level of
retired pay to full coverage and a full waiver of indebtedness created by
such. He has agreed to pay the buy-in required for him to increase his
base amount.
_________________________________________________________________
STATEMENT OF FACTS
On 18 October 2006, the Board considered and denied his application for
correction of military records pertaining to subject applicant. However,
the Board agreed to reconsider his case should he agree to pay the buy-in
for such action. For an accounting of the facts and circumstances
surrounding the applicant’s request and the rationale of the earlier
decision by the Board, see the Record of Proceedings at Exhibit D.
In a letter dated, 25 October 2006, the applicant indicates that he agrees
to pay the buy-in but is petitioning the Board to limit the buy-in to the
principle amount and not include interest on same.
Applicant’s complete submission is at Exhibit E.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
We note the applicant’s willingness to pay the buy-in required to increase
his SBP base amount from a reduced level of retired pay to full coverage.
His request that the buy-in amount be principle only and not include
interest requires no action on our part as the buy-in does not include
interest accrued over time. Inasmuch as the Office of Primary
Responsibility (OPR) recommended his application be approved should he
indicate his willingness to pay the required buy-in amount we agree with
the OPR and therefore recommend his record be corrected as recommended
below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to applicant be corrected to show that on 31 August 1988, he elected spouse
and child Survivor Benefit Plan (SBP) coverage based on full retired pay.

_________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPPRT states even though his retiree account statements have erroneously reflected his full retired pay as the annuity base amount for over seventeen years, the monthly cost deducted is based on the reduced annuity he elected prior to his retirement. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the...

Had the applicant submitted a valid election within the time prescribed for making an SBP election after retirement, monthly premiums would be approximately $81. Approval of this request would provide the applicant an additional opportunity to elect SBP coverage not afforded other retirees similarly situated and is not justified. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force...

_________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPPTR notes if the member submitted an open enrollment election and survives for two years, his spouse would be entitled to an SBP annuity of approximately $685 per month upon his death. The applicant contends he was advised, in August 2004, that he had to wait for one year after his marriage to secure Survivor Benefit Plan coverage for his second spouse and subsequently, in July 2005, he was...

On 11 March 1999, the applicant submitted a request to terminate his SBP coverage under the provisions of PL 105-85. PL 108-375 authorized an open enrollment period from 1 October 2005 through 30 September 2006 to enroll in SBP, but the law stipulates that servicemembers who terminated coverage under the provisions of PL 105-85 can not renter the program. _________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence...

_________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPPRT contends there is no evidence of Air Force error or injustice in this case; however, in the event the member provides the required election statement and documents neither party has remarried, it would be appropriate to correct his record to reflect that on 20 July 1995, he elected to change SBP spouse and child to former spouse coverage based on full retired pay, naming his former spouse as...

The Air Force developed the SBP RIP (report-individual person), a tool for counselors to use for one-on-one briefings conducted prior to a member’s retirement. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. ...

There is no record he submitted an election to provide coverage for her at that time. It would be inequitable to those members, who chose to elect spouse coverage when eligible and subsequently received reduced retired pay, to provide an additional opportunity for this member to change his SBP election. DPPRT states the former member elected child only SBP coverage based on full retired pay prior to his 1 February 1975 retirement, but he did not report or document he had a disabled child. Should the applicant provide the requested information, this Board would be willing to review the documents for possible reconsideration. Exhibit C. Letter, SAF/MRBR, dated 28 Jul 06.
