APPLICANT REQUESTS THAT:

The Southwest Asia Service Medal (SWASM) be added to his DD Form 214.

APPLICANT CONTENDS THAT:

His DD Form 214 reflects in support of Operation Desert  Shield/Desert
Storm, but the SWASM is not listed.

In support of the appeal, applicant submits a copy of his DD Form 214.

Applicant's complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

Applicant is a former member who served from 2 Jul 87  to  5  Jan  94.
His  records  reflect  he  was  assigned  with  the   18th   Equipment
Maintenance Squadron, Kadena Air Base, Japan from 14 Jul 89 to  13 Jul
90.

AIR FORCE EVALUATION:

AFPC/DPPPR  recommends  disapproval.   DPPPR  states   there   is   no
indication in the applicant’s records he was physically present in the
Area of Responsibility  and  he  has  not  provided  documentation  to
substantiate his claim.

To be awarded the  SWASM  a  servicemember  must  have  been  deployed
overseas in the Area of Responsibility for 30 consecutive days, as  do
all other Persian Gulf awards.

A complete copy of the evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
27 Oct 06 for review and comment within 30 days.   As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for  the  conclusion  that  the
applicant  has  not  been  the  victim  of  an  error  or   injustice.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
