APPLICANT REQUESTS THAT:

His Air Force Commendation Medal (AFCM)  be  upgraded  to  the  Bronze  Star
Medal (BSM).

APPLICANT CONTENDS THAT:

During his tour in Vietnam he was informed that he would be recommended  for
the BSM.  However, it was downgraded because of command policy.

In support of his request, the applicant provided a personal  statement  and
documents extracted from his military personnel records.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant having served 28 years and 6 months  on  active  duty  retired
from the Air Force on 1 March 1987 in the grade of  senior  master  sergeant
having assumed that grade effective and with a date of  rank  of  1  October
1982.  He served in the Republic of Vietnam from 14 February 1967 through  5
December 1967.  His DD Form 214, Report of Separation or Discharge from  the
Armed Forces, indicates that he was awarded the  Meritorious  Service  Medal
with two oak leaf clusters, Air Force Commendation Medal with two  oak  leaf
clusters, Air Force  Achievement  Medal,  Presidential  Unit  Citation,  Air
Force  Outstanding  Unit  Award  with  valor  device  with  three  oak  leaf
clusters, Air Force Good Conduct Medal with one silver and  two  bronze  oak
leaf clusters, Army Good Conduct  Medal,  National  Defense  Service  Medal,
Armed Forces Expeditionary  Medal  (Vietnam),  Vietnam  Service  Medal  with
three bronze service stars, Humanitarian Service Medal, Air  Force  Overseas
Short Tour Ribbon, Air Force Overseas Long Tour Ribbon  with  two  oak  leaf
clusters, Air Force  Longevity  Service  Award  with  one  silver  oak  leaf
cluster, NCO Professional Military Education  Graduate  Ribbon,  Small  Arms
Expert Marksmanship Ribbon, Air Force Training Ribbon, Republic  of  Vietnam
Gallantry Cross with Palm Device,  and  the  Republic  of  Vietnam  Campaign
Medal.

AIR FORCE EVALUATION:

AFPC/DPPPR  recommends  denial.   DPPPR  states  two  separate   performance
reports  for  the  years  in  question  (1966-1967)  indicates   “Comparable
performance, fully anticipated, during the  remainder  of  his  tour  should
result in his being recommended for the Bronze  Star.”   The  statement  was
again repeated in  another  performance  report  which  states  “His  tiring
efforts and outstanding performance resulted in him  being  recommended  for
the Bronze Star.  DPPPR did not locate  a  special  order  or  any  official
recommendation from higher headquarters awarding  the  applicant  the  basic
BSM for his service in Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 4 August 2006, the evaluation was forwarded to the applicant  for  review
and comment within 30 days (Exhibit D).  As of this date,  this  office  has
received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after reviewing  the  evidence  of  record  along  with  the
applicant’s  submission,   the   Board   agrees   with   the   opinion   and
recommendation of the Air Force and adopts its rationale as  the  basis  for
their conclusion that the applicant has not been the victim of an  error  or
injustice.  The Board is not unmindful or unappreciative of his  service  to
this Nation.  However, in the absence of evidence which would  show  to  the
satisfaction of the Board his entitlement to award of  the  BSM,  the  Board
finds no basis  to  favorably  consider  his  request.   Therefore,  in  the
absence of evidence to the contrary, the Board finds no compelling basis  to
recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or an injustice; the application was denied without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
