APPLICANT REQUESTS THAT:
He be awarded the Bronze Star Medal (BSM).

APPLICANT CONTENDS THAT:
A lieutenant colonel in his unit told him that he would write him up to be
awarded the BSM for his involvement in the Easter Offensive in 1972.
However, following his request to identify all awards and decorations
awarded to him during his military career, he discovered he never was
awarded the BSM.
In support of his application, the applicant has provided a personal
statement. The applicant’s complete submission, with attachment, is at
Exhibit A.

STATEMENT OF FACTS:
The applicant’s military personnel records were unable to be located.
According to the DD Form 214, Armed Forces of the United States Report of
Transfer of Discharge, submitted by the applicant, he enlisted in the
Regular Air Force on 28 July 1971 at the age of 18 for a period of four
years in the rank of airman basic (E-1). He was progressively promoted to
the grade of airman first class (E-3) effective 1 March 1972. Following
his completion of basic training and technical training, he served as a
radio operator.
The applicant was honorably discharged on 15 November 1973. He served a
total of 2 years, 3 months, and 18 days on active duty with 11 months and 2
days of foreign service.
The applicant’s DD Form 214 reflects he was awarded the National Defense
Service Medal (NDSM), Air Force Outstanding Unit Award (AFOUA), Vietnam
Service Medal (VSM), Republic of Vietnam Campaign Medal (RVCM), and the
Vietnam Gallantry Cross with Palm.
A DD Form 215, Correction to DD Form 214, issued on 23 November 1998, added
the Presidential Unit Citation, Bronze Service Star to his award of the
VSM, and a “V” (Valor) device plus 2 Oak Leaf Clusters to his award of the
AFOUA.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends disapproval of the applicant’s request for the BSM.
DPPPR states the applicant’s records have been lost and he has not provided
documentation to substantiate the award of the BSM, such as an award
recommendation, special order, or citation. In November 1998, the
applicant’s records were reviewed and no documents were found to
substantiate his award of the BSM. The DPPPR evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 4
April 2006 for review and response within 30 days (Exhibit D). As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. After a thorough review of the available
records, we found no evidence that the individual is eligible for the award
of the BSM. The applicant did not provide any documentary evidence to
substantiate his claim or, that he was recommended for, or awarded, the
BSM. Therefore, we agree with the opinion from the Air Force office of
primary responsibility that the applicant is not a victim of error or
injustice in regard to award of the BSM. In view of the above, we find no
basis to favorably consider this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
