APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Air Force
Commendation Medal (AFCM).

APPLICANT CONTENDS THAT:
On 1 Sep 69, he arrived in the Republic of Vietnam. At the time of
his tour in Vietnam, his last name was different, which he later had
changed. He was stationed at Nha Trang Air Base (AB). Shortly after
arriving at Nha Trang AB, his squadron commander told him that any
person who didn’t get into any kind of trouble while stationed there
would be put in for the AFCM. He doesn’t have the number of his
squadron, but it was a consolidated squadron. He also doesn’t have
the name of his squadron commander, as he was only there a short time.
He did not get into any trouble while he was there, and he completed
a full tour of duty. However, he never received a medal. He now
desires to be awarded the AFCM for his service in Vietnam.
In support of his appeal, the applicant provided an expanded statement
and a change of name decree.

STATEMENT OF FACTS:
Applicant enlisted in the Regular Air Force on 28 Mar 58. He was
relieved from active duty on 31 Aug 75 and retired for length of
service, effective 1 Sep 75 in the grade of technical sergeant. He
was credited with 22 years, 3 months, and 11 days of active service.
The remaining relevant facts pertaining to this application are
contained in the letter prepared by the appropriate office of the Air
Force.

AIR FORCE EVALUATION:
AFPC/DPPPR recommended denial noting the applicant was stationed at
Nha Trang AB, Republic of Vietnam, with assignment to the 14th
Transportation Squadron, from 4 Aug 69 to 15 Oct 69 and 327th Combat
Support Squadron from 16 Oct 1969 to 11 Mar 70.
According to AFPC/DPPPR, the applicant provided no documentation such
as a citation, special order, certificate, or decoration
recommendation that was submitted by the recommending official (i.e.,
supervisor, squadron commander, etc.) to substantiate his claim for
award of the AFCM.

Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 28
Apr 06 for review and response within 30 days. As of this date, no
response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility (OPR) and adopt its rationale as the
basis for our conclusion that the applicant has not been the victim of
an error or injustice. Therefore, in the absence of evidence which
shows to our satisfaction the applicant met the established criteria
for award of the AFCM, we find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
