RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2006-00730
INDEX CODE: 100.00
COUNSEL: NONE
HEARING DESIRED: NOT INDICATED
MANDATORY CASE COMPLETION DATE: 12 September 2007
_________________________________________________________________
APPLICANT REQUESTS THAT:
He be given credit for a temporary duty (TDY) to Korea in 1968.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He was in Korea when soldiers were exposed to high levels of
radiation. Since his records do not show he was in Korea, the
Department of Veterans Affairs (DVA) will not take his word for it.
In support of the appeal, applicant submits a copy of his DD Form 214
and a copy of a letter requesting documents that verify the location
and the length of time he spent in Korea.
Applicant's complete submission, with attachments, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
Applicant is a former enlisted member of the Regular Air Force that
served on active duty from 12 October 1965 through 27 February 1969,
as an Air Cargo Specialist. During this period he completed 3 years,
4 months and 15 days on active duty. He served one year of foreign
service.
________________________________________________________________
AIR FORCE EVALUATION:
AFPC/DPAPP recommends the application be denied and states, in part,
that there is no documentation to verify applicant was TDY to Korea
while assigned to the 835th Transportation Squadron from 1965 to 1969.
The AFPC/DPAPP evaluation is at Exhibit C.
_________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
He was sent TDY from McConnell AFB to Osan AB, Korea from January to
May 1968, during which time he loaded over 12 servicemen who were
killed-in-action (KIA).
In further support of his appeal, applicant submits copies of
photographs taken during the period in question.
Applicant's complete responses, with attachments, are attached at
Exhibit E.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. The
photographs provided by applicant are noted, but he has provided no
documentation to substantiate that he was assigned TDY to Korea.
Therefore, in the absence of evidence to the contrary, we find no
basis to recommend granting the relief sought in this application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
