APPLICANT REQUESTS THAT:
Her Home of Record (HOR) be changed from Sioux Falls, South Dakota,
to San Diego, California.

APPLICANT CONTENDS THAT:
She was born and raised in San Diego, CA and was maintaining a
residence there at the time of her enlistment. She was only in
Sioux Falls, SD to look for job opportunities and then decided to
enlist in the Air Force. She was there for approximately three
months when she enlisted.
In support of her appeal, the applicant submits copies of her State
of California Department of Motor Vehicles Registration
Information, her 2001 W-2 and Earnings Summary, and Palomar College
transcripts.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
senior airman and has a date of separation of 24 Jun 06.
The applicant enlisted in the Delayed Entry/Enlistment Program
(DEP) on 7 Mar 2002 from a Sioux Falls SD address and at the Sioux
Falls SD Military Entrance Processing Station (MEPS). She was
discharged from the DEP and enlisted in the Regular Air Force on
25 Jun 2002 for a period of four years. Her DD Form 4/1,
Enlistment/Reenlistment Document, reflects Sioux Falls, SD, as her
HOR.

AIR FORCE EVALUATION:
HQ AFPC/DPPAE recommends the applicant’s request be denied. The
applicant has not provided any supporting documentation to show the
current HOR of Sioux Falls, SD is in error.
The Joint Federal Travel Regulation (JFTR), Vol 1, Appendix A,
Section H is clear. Based on interpretation of the JFTR the intent
of the statue and JFTR language is for HOR to remain constant
throughout a member’s career unless there was a break in service of
one full day or a bona fide error was made in recording information
given by the member.
On 20 Mar 06, AFPC/DPPAE requested the applicant provide
documentation to support her claim (i.e., 2002 W-2 from CA, if
wages were earned any time during that year, a photocopy of CA
drivers license issued before entry on active duty, or a copy of
her CA vehicle registration, etc.), but no response or
documentation was received. Additionally, the applicant states she
was only visiting SD at the time of her entry into DEP, but did not
return to CA before entering the Regular Air Force. She could have
signed up for DEP in SD and returned to CA. From there [CA] she
would have been discharged from DEP and enlisted into the Regular
Air Force…which would have established her HOR as CA. This is a
routine process through an Air Force recruiter.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 26 May 06 for review and comment within 30 days. To date, a
response has not been received (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. In this respect, we note the
applicant has provided documentation to validate her residency in
California up to April 2002. We believe this is sufficient enough
evidence to establish she had been a resident of California just
prior to her visit to South Dakota. It appears the address listed
on her enlistment documents was a temporary address where she was
residing while looking for job opportunities. In view of this, we
believe any doubt should be resolved in the applicant’s favor.
Accordingly, we recommend that the applicant’s records be corrected
as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that her home of record
(HOR) is San Diego, CA, rather than Sioux Falls, South Dakota.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the
Air Force relating to [APPLICANT], be corrected to show that her
home of record (HOR) is San Diego, CA, rather than Sioux Falls,
South Dakota.

After a thorough review of the applicant’s military records, DPPAE found no documentation to substantiate changing his HOR. However, his application does not convince us that the HOR currently reflected in his records was incorrectly recorded at the time he was initially ordered to active duty.

His wife's DD Form 214 shows she entered active duty in San Diego, CA and that her HOR is in San Diego. It states, in pertinent part, that the HOR address entered on the enlistment contract will be the address declared by the applicant to be their permanent home or actual home at the time of enlistment. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.
