APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Humanitarian Service Medal
(HSM).

APPLICANT CONTENDS THAT:
He should be awarded the HSM based on his participation in relief efforts
for flood victims in Kentucky and West Virginia in May 84.
In support of his appeal, the applicant provided a copy of his Airman
Performance Report and congressional correspondence.

STATEMENT OF FACTS:
Applicant’s military personnel records indicated the applicant enlisted in
the Regular Air Force on 11 Jan 73 for a period of six years in the grade
of airman basic. He was honorably discharged under the provisions of AFR
39-10 (Unsatisfactory Performance) in the grade of staff sergeant. He was
credited with 14 years, 4 months, and 1 day of total active service. He
was awarded the Air Force Longevity Service Award Ribbon with two Bronze
Oak Leaf Clusters, National Defense Service Medal, Air Force Overseas Long
Tour Ribbon with one Bronze Oak Leaf Cluster, Air Force Training Ribbon,
Air Force Outstanding Unit Award, and the Air Force Good Conduct Medal with
Medal with one Bronze Oak Leaf Cluster.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial noting the HSM was awarded and approved for
three Flood Relief Operations in West Virginia and Virginia. After a
thorough review of the applicant’s records, AFPC/DPPPR indicated they were
unable to find evidence the applicant participated in the approved
operations. They indicated the applicant may have helped in flood relief;
however, it was not during the approved time frames.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 17 Mar 06
for review and response. As of this date, no response has been received by
this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
