APPLICANT REQUESTS THAT:

The extension agreements he signed on 28 Sep  04  and  28  Oct  04  be
cancelled.

APPLICANT CONTENDS THAT:

He was counseled by the Military Personnel Flight (MPF) that he  could
extend his enlistment to gain retainability  to  receive  a  follow-on
assignment after a short overseas tour after which he could cancel the
extension and reenlist.  The only stipulation was he had  to  reenlist
before he actually entered  into  the  extension.   However,  when  he
attempted  to  cancel  the  extension,  the  MPF  at  his  short  tour
assignment informed him he had been given  incorrect  information  and
was not allowed  to  cancel  his  extension  even  if  he  reenlisted.
Consequently, when he does reenlist, he will not receive  the  maximum
Selective Reenlistment Bonus amount.  He states he has learned  he  is
not the first person this has happened to.

In support of his appeal, applicant submits copies of  AF  Form  1411,
“Extension or Cancellation of Enlistment in the Regular Air  Force/Air
Force Reserve.”

STATEMENT OF FACTS:

The applicant is presently serving on active  duty  in  the  grade  of
staff sergeant (SSgt).  He entered into his current  enlistment  on  2
Feb 01 for a period  of  five  years,  which  established  a  date  of
separation (DOS) of 1 Feb 06.  In Jul 04, the  applicant  received  an
assignment and was required to  obtain  one  month  of  retainability,
which he did on 28 Sep 04.  The applicant later received  notification
of an  approved  follow-on  assignment  and  was  required  to  obtain
additional retainability to qualify for the assignment.  On 28 Oct 04,
the applicant again extended his enlistment for 25 months  to  qualify
for the assignment.

AIR FORCE EVALUATION:

AFPC/DPPAE recommends partial approval  of  the  applicant’s  request.
They recommend that the extensions executed by the applicant on 28 Sep
and 28 Oct 04 be declared void and that his records  be  corrected  to
show that on 28 Sep 04, he entered into an extension for a  period  of
48 months, with entitlement to a Selective Reenlistment  Bonus  (SRB),
Zone B, Multiple 5.5 (to be paid on the day the applicant  enters  the
extension, provided  he  remains  qualified).   This  will  allow  the
applicant to qualify for both his assignments and,  by  extending  the
maximum of 48 months, he would be entitled to 48 months of SRB once he
enters the extension in Feb 06.

AFPC/DPPAE  provides  a  copy  of  an  extract   from   AFI   36-2606,
“Reenlistment in the Air Force.”

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
13 Jan 06 for review and comment within 30 days.  To date, a  response
has not been received.  However, the applicant was  contacted  via  e-
mail to determine if he concurred  with  the  recommendation  made  by
AFPC/DPPAE.   The  applicant  indicated  his  concurrence   with   the
recommendation.

A copy of the e-mail is at Exhibit E.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been  presented  to  demonstrate
the  existence  of  error  or  injustice.   The  Board  accepts   the
recommendation of the Air Force Office of Primary Responsibility that
the applicant’s request be partially  approved.   The  applicant  was
contacted via e-mail and  has  indicated  his  concurrence  with  the
recommended relief.  Therefore, we recommend his records be corrected
as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that:

        a.  The one-month extension of his 2 February 2001 enlistment
executed on 28 Sep 04 be declared void.

        b.  The 25-month extension of his 2 February 2001  enlistment
executed on 28 Oct 04 be declared void.

        c.  On 28 Sep 04 he executed a 48-month extension of his    2
February 2001 enlistment, with entitlement to a Zone B, Multiple 5.5,
Selective Reenlistment Bonus (SRB).

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

      The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that:

            a.  The  one-month  extension  of  his  2  February  2001
enlistment executed on 28 Sep 04 be, and hereby is, declared void.

             b.  The  25-month  extension  of  his  2  February  2001
enlistment executed on 28 Oct 04 be, and hereby is, declared void.

            c.  On 28 Sep 04 he executed a 48-month extension of  his
2 February 2001 enlistment, with entitlement to a  Zone  B,  Multiple
5.5, Selective Reenistment Bonus (SRB).
