APPLICANT REQUESTS THAT:

He be awarded  the  Air  Medal  with  “V”  device  and  the  Combat  Aircrew
Insignia.

APPLICANT CONTENDS THAT:

He flew approximately 900 combat hours while in Vietnam.

In support of his request, applicant submits a copy  of  his  DD  Form  214.
His submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the  Regular  Air  Force  on  7  April  1966.   He
performed duty as an aircraft Maintenance Specialist.  On  6 February  1970,
he was honorably released from  active  duty,  having  served  3  years  and
10 months of continental service and 1 year  of  foreign  service.   He  was
transferred to the Air Force Reserve for completion of his military  service
obligation (6 April 1972).  His discharge document shows he was awarded  the
National Defense Service Medal, Republic of Vietnam Campaign Medal,  Vietnam
Service Medal, Air Medal, the Air Force  Good  Conduct  Medal  and  the  Air
Force Commendation Medal.

AIR FORCE EVALUATION:

USAF/XOOT recommends the application be denied.  XOOT advises that  although
the applicant performed duties in an aircraft during his tour in Vietnam  he
was assigned as Second Priority Personnel (Noncrew Members).  This  position
is the equivalent to an operations support  member,  although  required  for
the mission, is not permanently assigned  to  a  flying  position  requiring
aircrew expertise.  The USAF/XOOT evaluation is at Exhibit B.

AFPC/DPPPR recommends the application be denied.   DPPPR  advises  that  the
applicant  was  awarded   the   AM   for   meritorious   achievement   while
participating in aerial flight from  11  April  1968  to  9  November  1968.
DPPPR states the Secretary of the Air Force approved the award  of  the  “V”
device for valor to Air Medals awarded  for  heroism  effective  21  October
2004.  AFPC/DPPPR evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 3 February 2006, copies of the Air Force evaluations  were  sent  to  the
applicant for review and comment.  As of this  date,  this  office  has  not
received a response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  After a thorough review of  the  available
records, we found no evidence the applicant is eligible  for  the  award  of
the Combat Aircrew Insignia or for the  “V”  device  with  his  awarded  Air
Medal (AM).  According to the evidence of  record,  although  the  applicant
performed duties in an aircraft during his tour in Vietnam, he was  assigned
as a non-crew member, thereby rendering the applicant not eligible  for  the
award.   In  addition,  the  applicant’s  AM  was  awarded  for  meritorious
achievement and the “V” device for the AM  is  only  authorized  for  valor;
therefore, he is not eligible for award of  the  “V”  device  with  his  AM.
Therefore, we agree with the assessment by the Air Force office  of  primary
responsibility and adopt their conclusions as our  findings  in  this  case.
Accordingly, the applicant’s request is not favorably considered.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
