APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Presidential
Outstanding Unit Citation (PUC), the Korean Service Medal (KSM), and
the Aviation Badge.

APPLICANT CONTENDS THAT:
He received the PUC during his tour of 13 August 1955 to 1 July 1956,
with the 6926th Radio Squadron Mobile. He earned his wings as an
aircrew member with the 4024th Bomb Squadron while in the Korean War
from 1 May 1955 to 17 June 1955.
He is also requesting assistance in obtaining medical documents during
his tour in Korea.

STATEMENT OF FACTS:
Applicant’s military records were destroyed in the 1973 fire at the
National Personnel Records Center (NPRC).
The available records revealed the applicant enlisted in the Regular
Air Force (RegAF) on 5 June 1953 and was honorably discharged in the
grade of staff sergeant (SSgt) temporary (T) on 4 June 1957. He
served four years of active duty military service to include 10 months
and 14 days of foreign service.
The DD Form 214 reflects he was awarded the National Defense Service
Medal (NDSM), the Good Conduct Medal (GCM), Air Force Outstanding Unit
Award (AFOUA).
On 4 January 2006, HQ AFPC/DPPPRA verified the applicant’s entitlement
to the AFOUA with two Oak Leaf Clusters (OLCs) and the Korean Defense
Service Medal (KDSM). His records will be corrected administratively
to add the medals to his records.
On 25 January 2006, SAF/MRBR advised the applicant that they are not
the custodians for medical records or x-ray files. They provided him
with a point of contact to obtain those records.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR states the unit the applicant was assigned to from
13 August 1955 to 1 July 1956 did not receive the PUC. Furthermore,
there is no documentation in the available records that indicate any
of the units to which he was assigned or attached submitted an
official recommendation for, or award of the PUC. The applicant has
not provided any documentation to support his request for award of the
PUC. Therefore, they recommend the applicant’s request for award of
the PUC be denied.
A complete copy of the evaluation is attached at Exhibit C.
HQ AF/XOOT states aviation badges are permanently awarded as a result
of being placed on flying status. A servicemember must have
demonstrated proficiency as an aircrew member and completed 150 hours
of flying duty, completed 10 combat missions or while assigned as a
aircrew member was incapacitated for further duty as such by reason of
being wounded as a result of enemy action or injured while discharging
the duties of an aircrew member for permanent award of the aircrew
member badge.
Although, the applicant has provided documentation showing he was
placed on Aeronautical Orders on 21 January 1955, he has not provided
any documentation indicating he was permanently awarded an aviation
badge or that he met the minimum requirements for permanent award of
the badge. Therefore, they recommend his request be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the Air Force evaluation and states the orders
he provided proves he was an aircrew member at the time
the units were awarded the Outstanding Unit Award. He also provided
documentation reflecting he passed the Air Force Specialty Code (AFSC)
exam for AFSC 29351 and a list of flights he flew as a Radio/Gunner
(Exhibit F).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. As stated, the applicant’s
records will be corrected administratively awarding him the KDSM. We
took note of the documentation the applicant provided in support of
his request for award of the PUC and Aviation Badge; however, the
Board agrees with the opinions and recommendations of the Air Force
and adopts their rationale as the basis for our decision that the
applicant has failed to sustain his burden that he has suffered either
an error or an injustice. There is no evidence in the applicant’s
military records that indicate he was officially recommended or
awarded the PUC from any of the duty organizations to which he was
assigned or attached. The Board acknowledges the applicant was placed
on aeronautical orders; however, it does not appear the documentation
he provided substantiates he met the minimum requirements for
permanent award of the aviation badge. We believe it should be
pointed out that the applicant's decorated service and sacrifice for
his country has not gone unnoticed. Notwithstanding this, no evidence
has been presented which has shown to our satisfaction that the
applicant met the established criteria for award of the PUC and
Aviation Badge. Therefore, in the absence of the evidence to the
contrary, the Board finds no compelling basis to recommend granting
the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
