APPLICANT REQUESTS THAT:

His record be corrected to show that he received the Air Force  Commendation
Medal (AFCM).

APPLICANT CONTENDS THAT:

A high-ranking official in his  fighter  plane  unit  gave  him  a  personal
commendation.

In support  of  the  application,  the  applicant  submits  a  copy  of  his
separation  document,  a  newspaper  clipping,  and  a   letter   from   his
congressman.  The applicant's complete submission, with attachments,  is  at
Exhibit A.

STATEMENT OF FACTS:

The applicant’s complete military records were  either  lost  or  destroyed.
The  following  information  is  extracted  from   partially   reconstructed
records.  The  applicant  entered  active  duty  on  19 February  1942.   He
performed duties as a Radio Operator  Mechanic.   The  applicant  served  an
overseas tour in the European Theater of Operations (ETO)  from  26 December
1942 to 23 September 1945.  He was honorably  discharged  in  the  grade  of
sergeant on 11 October 1945 and was credited with  10  months  and  6  days’
continental service and 2 years, 9 months and 17 days’ Foreign Service.   He
participated in the Tunisian, Sicilian, Naples-Foggia,  Rome-Arno,  Southern
and Northern France, Rhineland and Central Europe battles and campaigns.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends denial.  DPPPR states there is no evidence  in  the
applicant’s personnel record that supports he was awarded the  AFCM.   DPPPR
notes  the  applicant  did   not   provide   additional   documentation   to
substantiate his claim for the AFCM.

DPPPR verified the applicant’s entitlement to the  following  awards:   Good
Conduct Medal with Army Loops, the World War II (WW II)  Lapel  Button,  the
American Campaign Medal, the European-African-Middle Eastern Campaign  Medal
with One Sliver Battle Star and Three Bronze Battle Stars,  and  the  WW  II
Victory Medal.  These awards were sent to the applicant on 17 June 2005.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

In his response to the advisory opinion, the applicant provided  a  detailed
account of the events which occurred during his wartime (Exhibit E).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  After a thorough review of  the  available
evidence and the applicant’s complete submission, we are not persuaded  that
his records should be corrected to show he is entitled to the award  of  the
Air Force Commendation Medal.  Other than his own assertions, the  applicant
has provided no documentary evidence that would  establish  his  entitlement
to the above-cited award.  We are not unmindful  or  unappreciative  of  his
service to his Nation.  However, in  the  absence  of  documentary  evidence
that, in our view, successfully refutes the  Air  Force  assessment  of  his
case, we have no basis on which to favorably consider this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
