APPLICANT REQUESTS THAT:
His records be corrected to show his entitlement to the Air Medal
(AM).

APPLICANT CONTENDS THAT:
He should receive the AM for being shot down and held as a prisoner
of war (POW) from 18 June 1944 to 29 April 1945.
In support of his request, the applicant submits WG AGO Form 53-98,
Certificate of Service, WG AGO Form 100, Army of the United States
Separation Qualification Record, and WD Form 384, Officer’s Pay,
Allowance, and Mileage Voucher.

STATEMENT OF FACTS:
Applicant’s military personnel records were destroyed by fire in
1973. His available records reflect he enlisted in the Army Air
Corps on 5 December 1943, and was released from active duty on
21 February 1946. He was a POW in Germany from 18 June 1944 until
29 April 1945.
His report of separation reflects award of the Purple Heart Medal,
the WWII Victory Medal, the European-African-Middle Eastern Theater
of Operations Ribbon w/2 Stars, and the American Theater Service
Ribbon.

AIR FORCE EVALUATION:
The AFPC/DPPPR recommends denial. DPPPR states they were able to
confirm his entitlement to the POW Medal. He served on active duty
from 5 December 1943 to 21 February 1946 and was held as a POW in
Germany from 18 June 1944 to 29 April 1945.
The AM is awarded to any person who, while serving in any capacity
with the Armed Forces of the United States, subsequent to
8 September 1939, distinguished himself or herself by heroic or
meritorious achievement while participating in an aerial flight.
Required achievement is less than that required for the
Distinguished Flying Cross, but must be accomplished with
distinction above and beyond that expected of professional airmen.
The applicant was never recommended for award of the AM.
His records reflect four missions of flights performed in direct
support of the European-African-Middle-Eastern Theatre. There is no
documentation in the applicant’s records to substantiate his claim
to the AM and he has not provided any documentation.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
11 Apr 05, for review and comment within 30 days. As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. After a thorough
review of the applicant’s submission and the available evidence of
record, we are not persuaded that the relief requested is warranted.
We took notice of the applicant’s complete submission in judging
the merits of the case to include his contention he should be
awarded the Air Medal for being a prisoner of war; however, we agree
with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. Therefore, we find no compelling basis to warrant
favorable consideration of the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence no considered with this application.

After a complete review of all three official military records they were able to confirm the two crewmembers received the DFC for a number of bombardment missions flown over Europe in June 1944, and the applicant receiving the Air Medal w/3 OLC in June 1944.
