APPLICANT REQUESTS THAT:

In the applicant’s request for  reconsideration,  he  requests  that  he  be
provided the opportunity to elect the Career Status Bonus  (CSB)  option  in
respect to his future retirement.

STATEMENT OF FACTS:

On 27 December 1988, the applicant enlisted in the Regular  Air  Force.   He
continued to reenlist contracting his last enlistment on 2 October 2002  for
a period of five years.  He is currently serving in the grade  of  technical
sergeant effective and with a date of rank (DOR) of 1 May 2001.

The applicant’s 14 years and 6 months of active duty  was  on  27 June  2002
with a 15-year point of active duty of 27 December 2002.

On 16 May 2005, the applicant made his election for the CSB.

On 23 May 2005, the applicant appealed his case for CSB  to  the  Air  Force
Personnel Center  (AFPC).   The  case  was  referred  to  HQ AFPC/DPPRC  for
review.  They concluded the applicant was not eligible for  CSB  because  it
was past his  16  years  of  Total  Active  Federal  Military  Service  Date
(TAFMSD).

In an application to the Board dated 18 June 2005, the  applicant  requested
he be provided the opportunity  to  elect  the  Career  Status  Bonus  (CSB)
option in respect to his future retirement.

On 14 September 2005,  the  Board  considered  and  denied  the  applicant’s
request.  A complete copy of the Record of Proceedings (ROP) is  at  Exhibit
E.






The Board staff received the applicant’s request for  reconsideration,  with
attachments (Exhibit F).  It appears the applicant’s  rebuttal  package  was
not  received  by  the  AFBCMR.   In  his  request  for  reconsideration  he
indicates vital information was  not  evaluated  during  the  Board’s  final
review as documents are  not  listed  in  the  exhibits  on  the  Record  of
Proceedings.

FINDINGS AND CONCLUSIONS OF THE BOARD:

After again thoroughly reviewing this application and the evidence  provided
in support of the appeal for reconsideration, the majority of the  Board  is
not persuaded the applicant has been the victim of either  an  error  or  an
injustice.  As noted in our original decision, the  applicant  completed  14
years and 6 months of active duty on 27 June  2002;  however,  he  made  his
election on 16 May 2005, over two years past his eligibility  date,  thereby
rendering him ineligible for the  program.   The  majority  found  that  the
applicant has not provided persuasive documentation indicating he was  never
notified of his eligibility to elect  CSB  at  the  14 years  and  6  months
timeframe.  AFPC/DPPRR has informally advised the  Board  that  neither  the
applicant’s  base  nor  AFPC  were  able  to  provide  a  copy  of  the  CSB
notification  letter  that  was  presumably  provided  to   the   applicant.
Nevertheless, the majority notes  that  information  and  criteria  for  the
program are readily available through the MPF, DoD and  AFPC  websites,  and
Base Career Advisors.  The applicant provides insufficient documentation  to
persuade the Board majority regarding what measures he took to research  the
program and his eligibility.  In view of this finding,  the  majority  again
concludes that the applicant has not established to their satisfaction  that
he has been the victim of an error or injustice.  Therefore, in the  absence
of evidence to the contrary, the  majority  finds  no  compelling  basis  to
recommend granting the relief sought.

A majority of the panel finds insufficient evidence of  error  or  injustice
and recommends the application be denied.

                 FOR CORRECTION OF MILITARY RECORDS (AFBCMR)

SUBJECT:  AFBCMR Application of

      I have carefully reviewed the evidence of record and the
recommendation of the Board members.  A majority found that applicant had
not provided sufficient evidence of error or injustice and recommended the
case be denied.  I concur with that finding and their conclusion that
relief is not warranted.  Accordingly, I accept their recommendation that
the application be denied.

      Please advise the applicant accordingly.
